Usually in these agreements they agree which will be the applicable laws and the courts that will be allowed to preside over any disputes. Am not sure about the jurisdiction of the comesa courts and how far they are allowed to question the decision of the highest court in Malawi which should be final, but in the European laws, EU courts will intervene on matters regarding EU law or trade between states…or a body that is an emanation of the state…there is a danger that allowing the comesa court to quash a supreme court judgment would set a dangerous precedent… Read more »
