Kasambara faults prosecutor, wants K5bn cash gate case dropped

Former Justice Minister and private practice lawyer Ralph Kasambara has asked the High Court in Lilongwe to discharge the case in which he and others are answering charges of money laundering involving K5 billion .

Kasambara and fellow lawyer Wapona Kita are also accused of conspiracy, possession of property suspected to have been stolen amounting K55 million while Pika Manondo and Kasambara are separately charged with possession of stolen property which is 11 vehicles, K22 million in Manondo’s custody and K5 billion in both their custody.

The former justice minister  told the High court on Monday that the state rushed to court when they were not ready with the case, hence the application to discharge the case and that all the accused person’s bail conditions must be varied.

He said the state can always resume the case when it would be ready with the case.

“It seems they rushed to come to court when they were not ready with the case. According to the case, if the [Oswald]  Lutepo case is not concluded, it means our case will not move. What if the case drags on?

“If they are ready they will tell us. It makes no sense for us to continue abiding to bail conditions,” said Kasambara.

Knowing that the case would delay to start, Kasambara applied to have the case discharged, bail conditions waived and that bank accounts and vehicles seized in connection with the case be released to the owners.

“The case should discharged until the prosecution is ready and if not bail conditions should be removed because as it stands, we can’t travel outside the country and our money is tied up,” said Kasambara.

State prosecutor Kamudoni Nyasulu did not respond to the application as he was not given notice.

High Court judge Chifundo Kachale is expected to make a ruling on the application Tuesday.

The state is expected to parade 11 witnesses and tender 39 documents as evidence against Kasambara and others.
