justice has been served. these guys really tried to hide everything and it showed that they were pros. but as they say that every sad story has a silver lining. I see the trio failing in the appeal because Judge Mtambo’s judgment showed demerits and merits and connected it very well. Appeal to all please start watching CSI or CSI: NY or Miami, things of this natureare the order of the day.

It was clear from the start that the Judge wanted Kasambala in no matter what……if one has been following this case from the start….You would clearly see that the state lacked evidence to bring down kasambala.People like Mtambo are a disgrace to the judicial system in this country

Even if one takes no side in this case, one would realise that Mary Kachale and team, failed to present evidence/proof (beyond reasonable doubt) for the trio’s conviction.
. . . And you may wish to know that “Burden of Proof (balance of probabilities in civil case)” and “Burden of Truth (beyond reasonable doubt, in criminal case)” are theories people learn at school, but in real life, the distinction is subtle and almost non-existent. And in legal matters, “Almost” does count.

There is a laid procedure to have a lawyer removed from the roll. And that process cannot be complete if a disciplinary hearing has not been made.

I am wondering how the discplinary hearing will be conducted without his presence as he will be in incarcaration.

The guys was a mafia. He deserved it.Kasambala if he were clean would not have any association with the other two criminals. He has to appeal. Remember ‘kicks of a dying horse’. Even a chicken which has its head cut off it ends up kicking you.

Eve if Mtambo had a vendetta against kasammbara as Kasammbara claimes no one can take it seriously because of Kasammbara’s own behaviour throughout the trial, he named the judge all sorts of names and worse enough threatened to punch him. If you remember very well, I said this before that Kasammbara was handling this case carelessly without considering the consequences. He at many times asked the judge to recuse himself a sign many suspected that he wanted to go on judge shopping a practice he is suspected to have been doing throughout his career as a lawyer.
