Malawi court senteces man to 4 years jail for sodomy

Mapuyu First Grade Court has sentenced a 25 year old man to 72 months IHL for sodomising a 17 year old boy, which is contrary to section 153a of the penal code.

The Court heard from the State prosecutor Sergeant Francisco Malunda that on February 24, the Suspect Gift Lilimasi who resides in Msundwe area coxed the 17 year old boy by giving him a K20 note to have sex with him.

According to Sergeant Malunda, the victim refused but was forced by the suspect and he was eventually sodomised.

The victim reported the matter to a member of the community policing, who later apprehended the suspect and brought him to Msundwe police unit.justice

When taken to court, the suspect pleaded guilty to the offence saying he committed the crime when he was under the influence of alcohol.

In mitigation, he pleaded with the court to be lenient with him when passing the judgment and also asked for forgiveness.

The state prosecutor asked the court to give a stopper punishment to the suspect because the crime he committed is a taboo in the country.

When passing his judgment, first grade magistrate, Elia Phiri, concurred with the state prosecutor saying cases of such nature are not common in the country and therefore, Lilimasi deserved 72 months imprisonment with hard labour to act as an example to other would be offenders.
