Former Malawi Attorney General Ralph Kasambara , who was arrested by Malawi Police, recently has sent a ‘vote of thanks’ to all people who supported him in any way during the past two weeks which he has been caged and has once again hit at the President Bingu wa Mutharika administration for being autocratic.
In a statement posted on his Facebook page entitled “vote of thanks from Ralph Kasambara and Family” the lawyer, politician and activist also reveals that he is responding well to treatment of his heart ailment at Mwaiwathu Private Hospital in Blantyre.
“I wish to take this opportunity to thank everyone who has extended a hand of support in the form of good wishes, visits and prayers for me while in prison and in hospital following the incredible events of the last two weeks,” writes Kasambara who has been an outspoken critic of Malawian President.
“I am happy to inform you that I am well on the road to recovery and my doctors are pleased with my progress so far. There are a few more tests and examinations to be conducted which should be through within the next seven days or so,” he added.
But Kasambara has expressed concerns with the impunity of the Mutharika government for disrespecting the rule of law in what should be a democratic state.
“Alarm, outrage and sorrow continue to be expressed by many regarding the unprecedented and ongoing attack on and disregard for our Constitution, which is the solemn code by which we as Malawians agree to conduct ourselves, our personal businesses and the affairs of the state,” said Kasambara.
“When court orders, such as my release orders, are blatantly ignored by Government, it is indeed a cause for alarm. Not only for me, but for anyone else who might be in need of relief from the justice system,” he added.
“It is clear that justice in total is delivered by the entire chain of correct and procedural actions from the police to the judiciary and the prison system. The proper separation and clear demarcation of functions of the three branches of government is the bulwark against dictatorship and the integrity of the links between the three is the basis of rule of law,” Kasambara pointed out.
“It is for this reason that we should all look beyond the current circumstances and pay careful attention to the worrying disintegration of integrity in the chain. It is worrying not just for one man, but for our entire nation.
“I am hopeful that through constructive engagement and working together as concerned Malawians we can get our country back on track delivering justice for all. This is the real issue which Malawians should be focusing on,” the statement reads.
Kasambara concludes his statement with a quote from Tony Lawrence which says: “Too many people are only willing to defend rights that are personally important to them. It’s selfish ignorance, and it’s exactly why totalitarian governments are able to get away with trampling on people. Freedom does not mean freedom just for the things I think I should be able to do. Freedom is for all of us. If people will not speak up for other people’s rights, there will come a day when they will lose their own”.
Meanwhile, Kasambara the idea of suing police for contempt of court following his continued detention although the court ordered for his release still stands.

ReplyThere are a number of lessons to be learnt from Ralph’s saga by Malawian CSO’s. The 1st lesson is that Bingu is an unmitigated bully. The 2nd lesson is that in his bullying he works through other people such as the IG and the ACB Director.
The 3rd lesson, and this is very important, in fighting back CSO leaders should focus on the people that Bingu uses to bully Malawians. Bingu himself is ‘untouchable’ but his henchmen aren’t. A lot of pressure should be brought to bear on these henchmen to the extent that they find it too costly to follow Bingu’s dictates. There are still a lot of measures that can be used to bring Bingu’s henchmen into line. Let them feel the heat.
Those people who are urging Ralph to keep quiet don’t understand the simple physchology of a bully: A bully likes a person who is afraid to fight back. Observe primary school kids. Once a bully finds a smaller kid who is willing to fight back, the bully moves on to another weaker kid. Even if the first kid lost when fighting back, the mere fact that he fought back unsettles the bully – he worries that next time he may lose…Image is everything to the bully.
Make no mistake, as his tenure draws to a close Bingu will intensify his bullying tactics. How far he succeeds will depend on how far Malawians are willing to let him get away with it. Fredrick Douglas put it most eloquently in the late 1800′s when he said ‘The limits of tyrants are prescribed by the endurance of those who are oppressed’.
