Malawiam court slaps man who sexually assaulted six girls 20 years imprisonment

A 45 year old man man identified as Davie Kagonegone has been sentenced to 20 years imprisonment by  a Zomba Senior Resident Magistrate Court for an offence of defilement of six girls under the age of 18 years contrary to section 138 (1) of the penal code.

When presenting facts before court, Eastern Region Police Prosecutor, Senior Superintendent Dickens Mwambazi said the convict had been having unlawful carnal knowledge, between the month of January and July 2016, with six girls between the age of five and seven.

It was also disclosed that on July 20 this year, one of the girl’s father found the convict caressing his daughter’s private parts.

“Upon being quizzed, the girl told her father that the convict had been defiling her together with other five girls one after another several times in his house and were given dried fish (kanyenya) as payment after telling them not to reveal to anyone.

“The matter was reported to Monkey Bay police post where all the six girls that were defiled were referred to Monkey Bay Community Hospital where medical reports revealed that all of them had been defiled.

“The convict pleaded not guilty to the offence and the prosecution team paraded 13 witnesses in which the convict had to answer to six counts leveled against him,” explained Mwambazi.

In his submission, superintendent Mwambazi asked the court to give the convict stiff punishment to protect young girls from such cruel men.

When passing judgment, Magistrate Agness Patemba concurred with the prosecutor saying she has an obligation to protect Malawians, especially young girls, hence slapped the convict with 20 years Imprisonment with Hard Labour for each count in which the sentences would run concurrently.

Kagonegone hails from Chilomo village in the area of T/A Nankumba in Mangochi district.

So uyu mwamanga koma Mphwiyo alibe mlandu azipita, mwaonatu, milandu yaikulu ikuluyi bola izipita ku ma magistrate court osati high court ayi, ndinso Esme Chombo saye kuweluza milandu yaikulu ikulu aziweluza za mmabanja basi, she is not suit to this.

Our penal code should also provide a maximum penalty of “mob justice”, this guy really got a lenient sentence. Just 20years. I think “one hour of mob justice” would have been more appropriate
