Mtumodzi case to be discontinued: Mzomera’s trial stalls

Prosecutors will discontinue a case involving Deputy Principal Secretary for Ministry of Disabilities and the Elderly Chikumbutso Mtumodzi on allegations that he was keeping guns.

Mtumodzi, former presidential spokesman, was arrested   former head of CID Bob Mtekama, accusing him of keeping firearms.

Police said they found a bayonet and an AK 47 toy gun at his house.

A bayonet – which can only be found with police officers- is a long blade adapted to fit the muzzle end of a rifle and used as a weapon in close combat.

Mtumodzi has however denied keeping guns, saying “there is no iota of truth” in the allegations.

Nyasa Times understands that the State wants to drop the case for “lack of evidence”.

The prosecution case collapsed due to inability to get objective material evidence, a source in the Ministry of Justice said.

“The case will be discontinued,” said the source.

The development follows after the State has discontinued the case of abuse of office against former Lilongwe City Council Chief Executive Officer Kelvin M’mangisa.

M’mangisa was arrested in July 2012 on accusations that he had drawn allowances for a trip to Italy which he did not undertake and had been collecting allowances outside his contract.

Ministry of Justice spokesperson Apoche Itimu said the case was discontinued on the 7th August 2013.

She said reasons for the discontinuance were communicated to the Legal Affairs Committee of Parliament .

Legal Affairs Committee Chairperson Kezzie Msukwa, while acknowledging that the committee has been informed of the decision, said the committee is yet to be briefed on the grounds for the move.

Meanwhile, the case by lawmaker  Rev Christopher Mzomera Ngwira who was  arrested on suspicion of misappropriating development fund has stalled.

Ngwira was arrested when he was in opposition DPP for allegedly abusing undisclosed millions of Kwachas meant for the development of his Constituency under the Constituency Development Fund (CDF).

But since he joined the ruling PP there has been no movement in the case.

Rev Ngwira, a former junior minister for Lands, Housing and Urban Development in the previous regime of late Bingu wa Mutharika, is also a Parliamentarian for Mzimba Hora Constituency.
