Judge demands inter-part hearing, Muluzi goes to Dowa

High Court Judge Esmie Chombo did not grant an injunction which opposition United Democratic Front (UDF) sought against Police order restraining its Presidential candidate from conducting whistle-stop meeting in the capital from Tuesday.

 UDF’s torch bearer, Dr Bakili Muluzi was stopped by police from conducting whistle-stop tours and instructed lawyers to obtain an injunction against police action. 

Lawyer Fahad Assani applied for an ex-part injunction at the High Court in Lilongwe but Judge Chombo could not immediately hear the matter. 

She ordered for an inter-party hearing to consider issues in the injunction on September 3 effectively paralyzing the planned whistle-stop tours in the capital. 

Assani however said an inter-party hearing is a blessing in disguise for their application. 

“We need an order to clear matters once and for all,” said the former Director of Public Prosecution. 

“We want political rights enshrined in the Republican constitution should be enjoyed by everyone else,” said the lawyer in apparent reference to limitation of freedom of association and assembly by the government of President Bingu Mutharika. 

Assani said whistle-stop meetings are done even by Mutharika but the ban has been affected on Muluzi only who is the main challenger of the incumbent in the presidential race. 

He said it smacked of discrimination. 

Meanwhile, UDF has announced that Muluzi will address political meeting in Dowa and Salima districts of the central region on Thursday.

Well done our police for stopping this madness of the so called whistle-stop tours.

It is a fact that whenever they are done, there are traffic jams inconveniencing innocent travellers.

It is a fact that the bring chaos on our roads and that vendors who usually accompany this man damage vehicles.

They bring back memoirs of the chaotic past ten years under this man which most Malawians would like to forget.

Roads are for all Malawians to use peacefully.Give the man a designated place to conduct his rallies, most people are not interested in chaotic situations that this man seem to enjoy.

What is special about Elson? You can not compare him with the prezident of the country. Elson is an ordinary person like me who goes to buy soap at METRO like me. So he is not above the law. Hands up judge Chombo.

* beleive the police have stopped the whistle stop-tours for Muluzi on good grounds and not political. * might ask myself if Muluzi had applied to the city authorities of his tours, and if yes, what was the reply from the authorities? It might look plausible with the rejection by police, but in other way it might look as a form of discrimination against the citizen of Malawi to hold meetings wherever possible, so it is better the police come out and tell the nation as to why they have stopped the tours. People are to judge if it was done in good faith or they are sent by people from above to stop these tours.

One other thing the police and these people who send the police to stop opposition meetings should know is that, they give the opposition room to be recognised as the fearful parties. * would love to see Muluzi address his rallies willfully so that come 2009 when he will lose, should not have grounds of complaints. * want him to see for himself that people are not sleepy as he thinks they are, when they will vote against him while he had all the chances of holding meetings. Uku ndiye kumupatsa matama Muluzi kuti aziganiza kuti boma likumuopa monga amanenera. Mpatseni mpata Muluzi achite misonkhano yake bwinobwino, kuti chaka cha mawa adzasowe ponamizira, kuti boma limandiletsa misonkhano yanga ndi chifukwa ndaluza chonchi. Ndifuna yekha adzadziwe kuti anthu salinso mtulo lero kuti angawanamizenso ngati kale ayi. Choncho a polisiwo kaya pali wina wawauza kuti amuletse misonkhano yakeyo, ndiye akumupatsa kutukumuka zedi. Ife zolalata zake tatopa nazo, mwakuti apa mwapereka kulalata zedi, mmene apite ku Dowako ndi Salima, palibe chabwino apa ayi.

When you are in poower remember always to treat those under you with diginity andwithin rule of law. * recall when we used to organize meetings for then Mbuya, police stopped us with authority from Muluzi not to hold meetings at Njamba. We went tohigh court on that Sunday afternoon and found Mwaungulu that time in the chambers who helped us out. So we used to say that time that Muluzi one day will reap all this and exactly 4 years now he is reaping his seeds.

Bingu too will reap whatever he is doing now and nkhonya yobwenzera imawawa!!!!

What did you do for Dowa people in your in the 10 years you were in power apart from castigating them for supporting MCP? What are you going to promise them this time? Muthalika has promised them a road which has not yet started. Do not take Dowa for a ride.

Sober up you sons and daughters of Adam.When will this allergy to democracy going to heal? None of the sides is honest and willing for a fair fight. If only Muluzi'* would leave his wild tongue when he whistle-tours around, he would deserve that travel pass. Similarly, if only Bingu was sinless in the same manner would he be deserving to deny Muluzi a pass.

Our Police, * feel sorry for you are partisan. We voted for change June 1993 but why remain behind. Muluzi is a Malawian and should be allowed to conduct political rallies. We should hear him and we make choice and concreate decission from there. Stopping him means fearing him. It also means denying the people rights to access information. Transformation is at danger

Please level the political play field. Muluzi has the right to everything that a Malawian citizen enjoys;no exception. If Bingu can do whistle stop tours why not Atcheya. Be civilized my country men.
