Nkungula: Malswitch operations?

Reserve Bank of Malawi [RBM] board meets today to discuss the shame pornographic materials of the General Manager of Malawi Switch Centre [Malswitch], Grey Nkungula which are in public domain.

The pictures of nudity and pornographic video have been circulating of fast rate since the news was broke yesterday and identities of the people were revealed.

Malswitch could not issue a statement on the matter. Many Malawians reacted to the issue through comments on Nyasa Times and discussion fora.

Some were against publishing the pictures or disclosing their identities as an intrusion of private life but others said the conduct of the married man to have extra sexual relationship with a married woman un deplorable.

“There is no time to waste with ethics here because to do so would be putting lives of so many innocent spouses at risk to HIV or STDs infection,” commented Timothy Nundwe a Malawian lawyer in Diaspora.

"There is a public interest matter here. This guy was filming himself having sex in a public office. It may also be possible that this laptop is a public laptop belonging to RBM. Do you condone public officials to be using public tax payer’s laptops to store private adult videos. This guy might even have been on public duty when he was busy kudya katundu wa eni,” commented Nundwe in his posting on Nyasanet.

Isaac Cheke Ziba another contributor said the issue bordered on data protection from where the material was retrieved during lap top repairs.

“If Malswitch ‘owned’ this lap-top, Malswitch must have been guaranteed safety of the information and material that was on that lap-top and I think that is where Nkungula may run into problems,” commented Ziba.

“The pictures look like they have nothing to do with Malswitch operations - they are purely personal (of course Malswitch may want to endeavor to guarantee that none of their sensitive information is out there - difficult but they should try),” argued Ziba.

He pointed out that Nkungula may be guilty of storing very sensitive personal information and data on a Malswitch piece of machine depending on their statutes.

“This personal information can not enjoy the guarantee that Malswitch may have been offered by the IT guys... Nkungula may be guilty of misusing company property depending on their statutes and he may have to pay so severely for this,” pointed out Ziba.

He said the IT guys may be guilty of assault on personal privacy of Nkungula – “but then the property in question is not his personal one - and I think that is where things start getting a bit sticky on his part.”

Thirdly, Nyasatimes should stop publishing these pictures. At least covering the story and maybe without names.

Lastly, people are finding time to blame SDA as a church. Wrong!!!! Why? It is crystal clear the church does not teach these to followers and if followers do on their own...than it'* not the church. Read what God says and you will appreciate that He does not want this. Catholic priests have had their nice times at Airports ....but we could not blame RC as a church. Moslems are also heard doing this...but we cannot blame Islam . If people have failed, it'* not religions that have.

It is crystal clear the behaviour is a clear injury to the victims (both their women'* husbands and Grey himself). He might require compensation for leakage of this damaging information but one might wonder, how were the videos taken? Was Grey authorize its contents given that he was have intimate moment with someone'* wife in a public office? Can questions like how long and how many he has been (with) into this trade be ignored? As much as it might have been done out of mutual agreement between the two (* assume no reported rape case), it is unfortunate for the young blood he might have modelled.

But then it occured to me that * have no right to judge him and the women he got involved with in those pictures. As christians what we need to do is to pray for these people. You will appreciate that satan is on the loose trying to embarass the church. This should come as a lesson to most Malawian internet users. People don'* differentiate between company property or personal property. A lot of people for example use company email addresses to send jokes and personal stuff, forgetting that in so doing they are wasting company time, server space etc, etc. The best is to use web based emails like yahoo or hotmail which are free anyway. A lot of Malawians wouldn'* survive in most international organisations. Companies need to come up proper contracts in line with modern advanced technology.
