Court sends Kamlepo, Makande to jail

kamlepoZomba Magistrate Court has given opposition United Democratic Front (UDF) deputy secretary general Hophmally Makande and Malawi Democratic Party (MDP) president Kamlepo Kalua a twenty month prison sentence

Makande was found guilty in an offence of proposing violence whilst Kalua was convicted for uttering seditious words.

The court heard that the offences were committed at the political rally of UDF during the closing of May 19 elections campaign in the lake side district of Mangochi.

Former president Bakili Muluzi addressed the rally.

The court established that the two politicians threatened that UDF would take the law into its own hands if Malawi Electoral Commission (Mec) did not rescind its decision to bar Muluzi from the presidential race.

Mec barred Muluzi from contesting on grounds that he already served his maximum two five year consecutive constitutional terms.

Recently, Kamlepo warned the governing Democratic Progressive Party (DPP) that he will call for mass action if it continues to promote tribalism and regionalism.

“Next year (2010) if we see DPP manifesto is not implemented. If we see there is too much tribalism, too much regionalism as we have seen, I will come out and I will tell the people that this is not what we fought for, what we wanted,” said Kalua.

“I am a political heavyweight. I am the only one that can stand up to [President] Bingu wa Mutharika and say that this is nonsense. Nobody can stand up and say this Bingu is nonsense. I am the only one that would go and challenge Bingu,” said the vocal politician who was among pioneers who championed Malawi change from one party dictatorship to democracy.

“I am the only one that challenged Dr Bakili Muluzi. I am the only one that challenged Dr Kamuzu Banda and I marched in Blantyre to Sanjika,” he said.

    Matabwa, do you why we alomwe are being mentioned now and again, Kaliati, just the other day carried 77 kids from her area to secondary schools and this to us (Lhomwes)is no crime. And when Harry Mkandawire questions some policies that to us is a crime. You see.

      what has this issue got to do with that of 77 less priveraged kids? tamanenani nkhani zenizeni panetipa some one when he was very senior in the education ministry did worse than this don’t get carried away look at issues with a sober mind.

    So you think by DOING that you are going to silence Kamlepo?It was people like Kamlepo who risked their lives during Kamuzu Banda’s time challenging Kamuzu Banda’s dictatorial regime when the cowards of Mose wa lero were hiding in Zambia and now making useless noise in Malawi.I don’t have any respect for BINGU.

    as a lawyer,i can only confirm what is an open secret in judicial corridors…nyakwawa usiwa usiwa is a DPP stooge who was once found with a dpp flag in his office drawer after the lock had jammed and a carpenter was called to fix it up.this was the time when he was hearing the case ivilving taxi drivers at zomba taxi rank who had allegedly assaulted hon yunus mussa,with whom they are very close buddies and also when he denied bail to chanco students for 3 days on the petty ‘offence’of demonstarting for their stationery allowance in the run up to the past election..it certainly is everyone’s right to belong to a political grouping of their choice,but such affiliations should not intefere with the principle of impartiality.

    the other day,his worship usiwa was drinking at matawale when one unfortunate chap casually made the careless remark that he was unhappy with the zomba magistrate court with regard to the way his case was being delayed.mr usiwa excused himself for a moment.unknown to all,he discreetly calledthe police who came cruising in their patrol vehicle and whisked the man away to police where he was remanded for 2 days!

    if the court felt that the evidence against che makande and baba kamlepo was compelling,well and good.however,the sentence appears to me to be very heavy handed and excessive,intended to victimise above anything else#

    it is,however,wrong in my opinion to bring in any mulakho ism here…

      wrong they deserved a much stiffer sentence to detter others from sconning an innocent president Mulala Ngwazi Bingu.don’t be tsankho advocate one Malawi one Nation

    Kamlepo’s offence had an alternative of suspended sentence or a fine. Why that the Magistrate decided to give the two same sentence? It’s only God who gives Justice to people.

    There is no serious offence Kamulepo has committed for him to be jailed. To you send someone to prison for say ” I will take law into my own hands?” Is it wrong for someone to say I will ask people to take to the street if one feels that the government is not doing what it promised? I beleive Kamulepo did not commit any crime worth a prison sentence.

        NGOZO – Holy crap, you dont make any sense here. Kamlepo and Makande have freedom of expression just like Bingu Wa Muntharika. They can say whatever is on their minds, its their birthright.

          Agreed freedom of expression but remember all freedoms go with responsiblities these guys acted irrisponsibly by inciting people to go to the streets to enable Muluzi to be allowed a third term thru the back door
