Magistrate acquits TVM presenter of defilement
Principal Resident Magistrate Mzondi Mvula has acquitted Malawi Television news anchor who stood charged with defilement and indecent assault.
In this matter, Oris Chimenya stood charged with defilement and indecent assault.
Particulars of the offence alleged that Chimenya between January and August 2009, the TVM presenter in Ndirande Newlines in the City of Blantyre on three different occasions had unlawful sex with the girl-child.
He pleaded not guilty to the charge.
According to the evidence, a medical report from Queens Central Hospital which indicated the girl had a sexually transmitted infection.
The victim had also bruises and a swollen vagina after the alleged sexual acts.
Delivering judgment in the matter, magistrate Mvula said there was no objective evidence to find Chimenya guilty.
“It’s beyond unreasonable doubt that defilement did not take place. So I dismiss the case,” said Mvula in his ruling.
The Magistrate gave the accused needed a benefit of doubt and acquitting him accordingly.
Chimenya, 31 a, a Polytechnic journalism graduate who formerly worked for The Nation Publications Limited was suspended by Television Malawi for the prosecution of the case.
