ICAM crackdown on Malawi accountants, expel Ufulu Nalivata: Joseph Kampondeni cleared but cautioned

Institute of Chartered Accountants in Malawi (Icam) has expelled its member Ufulu Nalivata after finding him guilty of fraud by obtaining payment in his favour using recycled supporting documents.

Ufulu Nalivata: Expelled by the Institute of Chartered Accountants in Malawi

In a statement exclusive issued to Icam members which Nyasa Times has obtained, the accountants body said Nalivata committed the crime while working with the National Council for Higher Education (Nche).

“His conduct was found to be in contrary to Section 2.3 of Icam disciplinary guidelines and Section 110 of Ifac code of ethics,” reads the statement.

Icam has also asked Nalivata to surrender to the institution’s secretariat the membership certificate by September 18 2018.

But Nalivata said he will seek an appeal against the Icam Ethics and Investigations Committee to the Malawi Accountants Board.

Icam statement also said the accountants body has cleared Joseph Kampondeni of gross negligence where he was accused of misconduct as head of funding and finance at Technical Entrepreneurial and Vocational Authority (Teveta) for allowing and processing disbursement of funds amounting to K18 million to a Lilongwe-based non government organisations, Ndi Tsogolo Lathu, without any written agreement or memorandum of understanding.

The statement said Icam council noted that Kampondeni facilitated payment for the money relying on approved signatures of the then Teveta executive director Ndione Chauluka.

Besides discharging him with a letter f reprimand, the council also cautioned him that as a professional accountant, he was expected to act more carefully and with more due professional care in the disbursement of the funds.

The aggrieved members have been advised that they have a right to appeal the account of their cases to Malawi Accountants Body.

Ufulu Nalivata is a hard core criminal. He forged documents while at Lilongwe District Council and went away with over K6 million. He ran away leading to the arrest of his immediate boss Kisyombe who was convicted and sentenced to IHL at Maula. It baffles me to hear that he sneaked into the country got a job at CoM, swindled again and again at NCHE. Araea 3 Police, this is the culprit you have been looking for. Apprehend him please.

Just read the surname. It was very easy for him to secure a job at NCHE. Bravo ICAM for your great professionalism. This is a good start.

It’s now called professionalism just because Ufulu’s surname suggests that he is not from your fucking stinking bushy Republic of NYIKa? I have always said that there is a cold war launched by the mTumbos over the Lhomwes and these two tribes are involving the whole country in their tribal wars as if Malawi has no other tribes. But it’s really a shame to see the whole northern region waging war on one small ethnic group (Lhomwes). The fact that all the northerners have been and are still failing to get the number ONE job on the land speaks a… Read more »

BTW, I support ICAM ‘s decision as long as there is no regionalism, nepotism and tribalism at ICAM. In fact, this case has caught my attention. I have to find out the regional composition of this board. We have seen some lawyers literally being convicted and sentenced to prison e.g. Kasambara. But their professional bodies have completely done nothing in disciplining them just because there is high regionalism and nepotism in those professional bodies. This Ufulu case really shows a change for the good if it is done in good faith without the ISMS loved and practiced by people from… Read more »
