The Chief Justice is also shielding errant judges. Look at the lifestyles of most judges. They have acquired many houses, splash money in clubs etc. And this is not commensurate with their earnings. They claim they are underpaid, have no fuel to do their job when only one month is skipped without fuel allowance. I know of on judge who has over MK 20 M on his fuel card. He cashes the money at filling stations.

Ine tsiku lina nditchula wonyenga mahule inu mukuthula okuba. “We had another worst case scenario when the MLS looked away when some lawyers who had been answering criminal charges were still allowed to practice and represent clients. What was even much mind-boggling was that such lawyers were actually representing their co-accused, answering similar criminal charges. It doesn’t’ get worse than this. My foot! This is indeed shameful, to the least”

In my recollection, unless the law has changed, the disciplinary committee does not have legal authority to disbar a legal practitioner. Rather it merely makes a recommendation to the office of the Chief Justice of the Malawi Courts for disbarment. A subsequent hearing in the High Court is then convened for the purpose of disbarment. The subject lawyers (in their individual capacities) on the one hand and the Solicitor General on the other hand will be parties to such a hearing. Disbarment may or may not be effected depending on the outcome of the High Court hearing.
