Rwandan nurse denies raping intoxicated Malawi nurse in Neno: ‘I thought she seemed to enjoy the sex  activity’

Malawi Police in Neno are keeping in custody a 44 year old Rwandan national identified as John Paul Bizimungu for raping a 19 year fellow nurse, a Malawian who was too drunk to meaningfully consent sex but he denies the charge.

According to Police, the two were working together as nurses at Partners in Health (PIH).

Neno Police Public Relations Officer (PRO) Raphael Kaliati said during the night of 2nd June 2016, Bizimungu visited the victim at her home where he went with bottles of liquor.

He later convinced the victim to drink the liquor telling her it was fruit juice.

“After the victim had taken the substance, she was intoxicated  and lost control. This is when the suspect took her to his house and had sex without her knowledge”, said Kaliati.

The Police Publicist said the suspect was later arrested after the victim reported the matter to police.

The woman said the  sex was nonconsensual,

He said Bizimungu is being charged with an offence of rape which is contrary to Section 132 of the Penal Code.

Bizimungu accepts he had engaged in sexual activity with his workmate. But he denied assaulting her, saying he thought she “seemed to enjoy the activity.”

He said his intentions were not to have sex with the workmate without her consent.

The Rwandan  said they both kissed and engaged in sexual activity, saying the woman took her pants off and “seemed to enjoy the activity.”

Bizimungu  is expected to appear before court soon at a date to be set.

At first she was sober, that was the right time for her to make the right choice whether to ignore the offer or control the consumption. She deserved it. To me that’s not rape.
