Three men jailed 4 years each on robbery charges

Lilongwe Senior Resident Magistrate has sentenced to four years imprisonment with hard labour (IHL) to three men after finding them guilty on the offence of robbery contrary to section 301 of the Penal code.

The court heard that the accused, 34 year olds Mack Kanyoza, Tannex Mtalika and 23 year old, Moses Siwama, on the night of 27th April, 2012 hired a Toyota Corolla registration number SA 5623 driven by Chipiliro Kanamu at Biwi Triangle only to attack him near SOS Village.

Passing judgement, Senior Resident Magistrate Patrick Chirwa said the offense is serious in nature and attracts a maximum sentence of life imprisonment if committed in aggravated circumstances.

“The court also considers that the offence herein was planned well in advance and was committed by a group of people. This coupled with the fact that the victim herein was vulnerable to attack of more than one person, aggravates the circumstance of the offence and qualifies for the maximum sentence,” said Chirwa.

Chirwa, however, noted that despite the fact that the offence was aggravated and well planned, the group neither used arms during the offence nor harmed the driver who they tied with a rope during the robbery.

“It should be mentioned that the court has already sentenced Mark Kanyoza, a co-accused and convict who pleaded guilty to this same case. He has been sentenced to a term of 3 years IHL. The court, therefore, arrives at a decision to sentence the convict Tannex Mtalika and Moses Siwina each to 4 years IHL. The sentences are to run from the days of their respective arrests,” said Chirwa.
