EU observers to issue fresh election report on Malawi
The European Union (EU) Election Observation Mission (EU-EOM) to Malawi delegation will jet back in the country on Wednesday January 8 2020 to isse a fresh report on the disputed May 21 2019 Tripartite Elections as the country awaits the Constitutional Court elections case ruling.
Head of Political Affairs at EU, Aurelie Valtat, has confirmed the development .
In a 12-page preliminary statement, dated May 23 2019, the mission said the elections was challenged by poor conditions and poor adherence to procedures.
The EU observers also punched holes in the electoral legal framework, especially on the absence of deadlines for filing and adjudicating election disputes.
EU-EOM also observed that the vote count was transparent with party monitors present in all polling stations observed.
However, the EU-EOM mission said closing was assessed as bad to very bad in 12 out of 32 polling stations observed, mostly due to inconsistency in following procedures and problems with reconciliation and completing the result sheets.
Malawi Electoral Commission (MEC) declared Peter Mutharika of Democratic Progressive Party (DPP) winner with 1 940 709 votes or 38.57 percent of the votes cast.
He was trailed by Lazarus Chakwera of Malawi Congress Party (MCP) with 1 781 740 votes (35.41 percent) while immediate-past vice-president Saulos Chilima of UTM came third with 1 018 369 votes or 20.24 percent.
MEC chairperson Justice Jane Ansah declared the presidential elections to be free and fair and that the results were the true reflection of the will of the people of Malawi.
But Chilima and Chakwera are seeking nullification of the results in the Constitution Court.
The Constitutional Court (ConCourt) —a panel of five judges: Justice Healey Potani, Ivy Kamanga, Dingiswayo Madise, Redson Kapindu and Mike Tembo—are faced with making the most momentous decision any Malawian court has ever made.
The ruling is expected either this month or early February.
If the ConCourt nullify the petition as prayed for by the presidential candidates who finished third and second in the disputed official tally—they will only become the second court ever on the African continent—after Kenya’s, to cancel a presidential election.
But this is the first time an election referral has reached this stage in Malawi. And it has done so to the backdrop of a huge political crisis and gripped the attention of the whole country with the 17 million Malawians unprecedentedly able to follow all the court hearings via mass media.

The problem with both Chakwera and Chilima is that both are inexperienced in politics, both lean towards violence, and would make a poor choice as leaders of a country. They are hungry for money and power. Don’t be fooled. They don’t care about Malawi or Malawians – this is about “its my turn to eat”. Once either one gets into power, they will be far worse than our dear president Dr. Peter Mutharika. They will make stupid new laws, and you will see massive cashgates, corruption and scandals on a scale never seen before in Malawi. Crime will increase at an unprecedented rate because these fools will not be able to control the police or the army. Malaiwians take note. This is all about power and money. These guys do not care about you and me, the ordinary citizens of Malawi – they care about power and enriching themselves. The sad thing is the way that they are using their power and funds to brainwash the public, to instigate demos, protests and violence in the country. From the way things have gone so far, with post-election violence, it is increasingly clear that both these two men have the qualities of a thug rather than a good leader.

The move by the EU is ill-timed and it is likely be heavily criticized. I pray that the EU exercises caution. My observation about the EU election reports have never been so critical other than rubber stamping the system despite all the flaws. They do so for political reasons at the expense of objectivity. The best the EU should have done was simply to remain silent and wait for court verdict, they already failed by declaring the elections free and fair which Mutharika uses to defend his re-election. Another useless organisation is the African Union which is breeding dictators in Africa.

Presentation of the report is ill-timed. The issue is in court and just awaits judgement. What purpose will this report serve. Why wait until judgement is out. I smell something.
We are waiting for a ruling from the court. A report from these Europeans will just complicate the scenario. It dilutes the pending ruling from our courts. If the courts ruling turns out different from this report, it will cast a dark cloud on the ruling and if the outcome of the court’s ruling was to be the same as this report, it will look like the Europeans have influenced the courts. Who is this report for, Malawians or Europeans. Certainly not Malawians. These Europeans are imperialists instigating division and confusion. Surely with the situation and tension in the country this report will only divide our country. Let the Malawian court do it’s job.
Our Malawian courts have the capability and the professionalism to make the right and just ruling. We don’t need any foreign powers to come in our country on this. We re competent enough.

I’m i getting it right or wrong? Was the EU-observer mission only assessed 32 polling stations of which they were suspicious with the end results of 12 out of that 32? Why only 32 out of hundreds or thousands of polling stations nationally? And why did they lie to the whole world that the elections were free and fair when only observed 32 and 12 were a flop? So how many flops could have been picked if they could observe atleast half of all the polling stations?
