40-year-old man jailed for sex attack on 13 years old

The Phalombe First Grade Magistrate Court on Tuesday this week convicted and sentenced a 40- year-old man, Mike James Banda to 14 years imprisonment with hard labour for defiling his 13-year-old step-daughter girl.

Banda, who committed the offence on between the months of May and August this year, pleaded guilty to the charge of Defilement contrary to Section 138 (1) of the Penal Code and was convicted forthwith.

According to information presented in court, the convict had been forcing himself on the 13 year-old girl (name withheld) on several occasions. And on each occasion, he gave her some money to ‘seal off her lips’. The victim is a standard four pupil.

It was during the month of August this year, when the girl started showing signs of pregnancy; and when she was quizzed, it was discovered that she was four-months pregnant. She pinpointed Banda as the one responsible for the pregnancy.

The convict was arrested on 6th September in Milepa-Chiradzulu where he was hiding.

First Grade magistrate, Damson Banda said the accused deserved a stiffer penalty to deter would be offenders.

Banda hails from Mgumera village in the area of Traditional Authority Mkhumba in Phalombe district.
