Malawi launches guiding policy for state prosecuting agencies

Government has launched a guiding policy for state prosecuting agencies to ensure prosecution uniformity.

Solicitor General Janet Banda said the guiding policy will harmonise the offices of the director of public prosecutions (DPP), state advocate, police and Anti Corruption Bureau.

“This policy will ensure that these prosecuting agencies conduct the prosecution with consistency and uniformity and will ensure timely disposal of cases,” said Banda.

Legal commentator Justin Dzonzi urged the government to ensure that the prosecution guiding policy is not in conflict with the law.

“All the prosecuting institutions are independent of the ministry of Justice. I hope the policy took note of their independence from government influence,” said Dzonzi.

He said the government should ensure that the agencies continue to enjoy their independence from authorities.

Independence from authorities? My foot! So long as the executive arm of government remains the appointing authority of the heads of these governance institutions expect political interference to be there.
