Court asks Uladi to replace lawyer Maulidi
The High Court has asked Minister of Home Affairs and Internal Security Uladi Mussa to find replace lawyer rPaul Maulidi because of his persistent failure to attend hearing in which United Democratic Front (UDF) president Atupele Muluzi is suing Mussa for defamation.
Atupele sued Mussa for allegedly uttering unfair remarks against him on Zodiak Broadcasting Station (ZBS) through a programme called Tiuzeni Zoona aired on April 14 2013.
In his claim, Atupele alleges that Mussa falsified his date of birth and said he (Atupele) was not fit to rule the country. Atupele described the remarks as defamatory.
The two parties agreed to mediation, but each time a date was fixed, Maulidi representing Mussa has not been available, prompting Atupele’s attorney Jai Banda to bring the matter to court.
Banda asked the court fort an order to strike out the defence because of Mualidi’s failure to attend trila.
The court set August 27 2013 for hearing but Maulidi also gave an excuse minutes before the hearing. Lawyer, David Nyasulu told the court that Maulidi told him that he was attending a presidential function. Maulidi is acting secretary-general of the ruling Peoples Party.
Matapa Kacheche, assistant registrar of the High Court and Supreme Court of Appeal in Blantyre, observed that Maulidi is always busy and that Mussa should engage another lawyer to speed up the defamation case against him.
The case has been adjourned to a date yet to be fixed.
