Balaka man jailed 8 years for sexual abuse on granddaughter

First Grade Magistrate’s court in Balaka district, eastern Malawi, has sentenced a 53-year-old man to 8 years imprisonment with hard labour for defiling his 4-year-old granddaughter.

The court heard from the State representative Prosecutor Sergeant Aida Mzama that the suspect Greev Chimutu defiled a four year old granddaughter on 26th October, this year at M’mangeni village in the district.

According to Mzama the victim met her fate when she was left with the suspect after her mother went to receive relief items which were distributed by Concern Universal in the area.

“Upon return home, the mother was surprised to hear her daughter crying from her father’s bedroom, and when she went to the scene, she was surprised to see her father coming out of his bedroom with his trouser down.”

She says the victim revealed to her mother that her grandfather a development that forced her to report to Balaka Police Station who arrested the suspect the same day.

Medical report obtained from Chendausiku Health Centre proved that the girl was really defiled.

The suspect pleaded guilty to the charge of defilement of girls under the age of 16 which is contrary to section 138(1) of the Penal code.

State Prosecutor Sergeant Aida Mzama, asked the court to consider giving the suspect a stiffer sentence considering the seriousness of the offence and that these cases are rampant in the district.

She also wondered as to where a girl child will be safe if she is not safe even in the hands of people who are supposed to protect her.

The prosecutor therefore asked the court to consider giving the suspect a stiffer sentence so that it should be a lesson to him and would be offenders.

In his mitigation, the suspect asked for forgiveness saying that he is the only elder person at his home and looks after orphans.

First Grade Magistrate Felix Mandala wondered as to why a 53 year old man can have sexual desire over a 4 year.

But considering that the convict is a first offender and that he pleaded guilty to charge, Magistrate Mandala sentenced the convict Greev Chimutu to 8 years imprisonment with hard labour.

He said he has given them such a sentence so that it should be lesson to him and would be offenders.

Greev Chimutu comes from M’manga village, Senior Chief Nsamala in Balaka district.
