Convicted Kasambala not struck off – Malawi Law Society

Despite a criminal conviction, former minister of justice  Ralph Kasambara ( Senior Counsel) has not been struck off and remains  on the roll of the accredited legal practitioners in the country, Malawi Law Soicety(MLS) has said.

According to the MLS Secretary General Khumbo Soko, Kasambara will still be the country’s lawyer until the Attorney General  (Kalekeni Kaphale) makes an application to the High Court to remove his name on the list of certified lawyers.

Soko also told the media that Kasambara is still recognized with the title of Senior Council (SC).

“He still recognized as one of the Malawian lawyers regardless of his jail sentence,” said Soko.

Soko, however, disclosed that Kasambara does not have a valid practising license because he did not renew it.

Justice Michael Mtambo sentenced Kasambala to 13 years prison term on the count of conspiracy to murder budget director Paul Mphwiyo.

Mphwiyo’s shooting is believed to have exposed the looting of public resources at the Capital Hill in Lilongwe and the case started in 2013.

Kasambara is one of the renowned lawyers in Malawi.

Nkhani yovutisisa apa njakuti ndani mwamakoswe ku MLS amange belu mphaka. It is quite apparent that people at MLS are afraid person by person to initiate an obvious process to de-register him. Ali ee akatuluka mkulu amene uja azamve kuti ndinamuchosesa ndine zanga zizada basitu.

Which lawyer has ever been disciplined in Malawi? They fornicate, steal, lie, kill, defile, cheat, intimidate, impregnate, rob, extort, embezzle, racketeer, rape, bribe, greese, corrupt, murder, defeat justice, pornograph, trade in sex and they still practice as lawyers!

Ndiye mumati they shoukd remove their masterminder from their register, what are you nuts?

Then the Malawi Judicial and legal system is a mockery to justice and non responsive and criminal in nature by allowing murders and criminals to practice. This is outrageous. Its undesireable professional. This can only happen in a mafia type of system where MLS disguised as Lawyers are simply mafias in carcoon. Does it surprise the world that Malawi is still managed by rotten 7 ministers embroided in deep theft and and crinamal looting of government funds. Kasambala’s conviction is personal. ..He has not conducted a crime against his profession…its just the same when you convict an engineer on acount of defilement. …then you say let’s remove him/her from professional list.

Nonsense.
There is such a concept as “bringing disrepute to the profession”. In other words, a professional does not have to commit a crime directly related to her/his professional activities to justify de-professionalisation. This is done all the time, all over the world. But the key is that the process has to be transparent.
…and another thing: why does the government or its rep get involved in expelling someone from a professional organization? The law society should have the powers to suspend or expel. Like a job for a disciplinary committee.No?

Everybody now knows that Ralph used to win cases by intimidating other lawyers and witnesses and bribing judges. As such, only fools and stupid people still believe that Ralph is/was intelligent. Wake up!

Malawi Law Society is one of the useless groups in Malawi which is also being led by useless lawyers. They all worship Kasambara. Stupidity at its best.

Once again we let emotions control us. Aren’t there procedures with proper approvals to bar someone from practicing law in the country? Sober up people. We might think that we will deal with Ralph with a knock out punch but things can take a different turn. Slow down please.

Cant agree more Nyati. This is a shameful profession now. Why shielding one another? Its absolutely a disgrace to the noble profession which is full of thieves, get rich quick type of people (through dubious means) by ripping-off poor innocent Malawians. Why not strucking off someone who is convicted? Are there any standards or ethics in the legal profession? SHAME!!
