Court embarrasses Muhara, Mutharika: Told they had no power to force Chief Justice retirement  

The office of the Chief Justice is now free from being encroached by the Executive arm of government after a High Court in Lilongwe has ruled  that f the country’s immediate-past president Peter Mutharika and former chief secretary to government Lloyd Muhara had no powers to force Chief Justice Andrew Nyirenda and Justice Edward Twea or any other judge to proceed on leave pending retirement.

Muhara:  Faulted by court

Prior to the fresh presidential election, Muhara wrote Nyirenda and Twea asking them to proceed on leave saying they had accumulated more leave days.

However, Malawi Law Society, Association of Magistrates in Malawi and Human Rights Defenders Coalition challenged the decision.

The applicants sought judicial review on the decision by the then president and secretary to cabinet.

They also made a plea that costs of the case be personally paid by Mutharika and Muhara to avoid wasting tax payers money.

In his ruling, High Court judge Charles Mkandawire faulted Mutharika and Muhara for interfering with roles of judiciary saying issue of leave is an internal issue for the judiciary.

He said the executive arm of government has no powers to dictate affairs of judiciary as the judiciary is an independent arm of government and is equal to the executive and parliament.

Mkandawire also faulted Mutharika for stating in his state of national address that parliament was more superior than judiciary.

He said Mutharika wanted to mislead the nation and interfere with judicial independence.

On the issue of costs, Mkandawire has pended the hearing to a later date saying there is need to summon Mutharika and Muhara so that they are represented considering that the lawyer for Mutharika and Muhara dumped the two on the costs issue.

The court will within seven days communicate to Mutharika and Muhara to have them represented in the costs issue.

    1. For Mervis Mangulenje, it was all about using bottom power to get and keep a good job. I doubt if she saw anything in this Muhara man.

    1. I agree. The shape tells a story. Dull man. In fact is the whole tribe. They were in government everywhere but they lost every case

  5. APM was embarrassing as a lawyer. These two guys were planning something when they decided to (1) change the army commander which they managed to do, (2) to force the Chief Justice into retirement which they failed, (3) to transfer George Kainja from Police to Zimbabwe High Commission which they failed, (4) to bring electoral bills so that APM does not assent which they failed, (5) to increase the number of covid-19 so that FPE should failed which they failed, (6) Lockdown so that elections don’t take place which they failed and thanks to Justice Kenyatta Nyirenda, (7) to infiltrate the top positions with APMs tribe which they succeeded, (8) to have kids register as voters in the Lomwe belt and Yao belt which was foiled by the Supreme Court, (9) form an alliance with UDF to achieve 50%+1 which Malawians foiled on 23 June 2020 etc. That is what happens when people want change. God will always side with people when they are in the hands of Pharaohs.

  6. The truth is always painful. Parliament is indeed superior than judiciary. Unless being moved by a petitioner courts are a passive and lifeless organisation of government. They cannot even determine there own salaries; tey have to beg executive and national assembly

  7. The chief justice has accumulated more days than it is necessary to serve. He can go on leave let strong young men act. The strange thing why is he refusing to go on leave? Somebody tell him rest is very important to an old body like his lordship.

  8. EVEN IF HE CAN STAY THERE FOR A HUNDRED YEARS ONE DAY HE WILL RETIRE HE IS NOT A LIFE CHIEF JUSTICE.
