Court stops Malawi govt ban of MSCE literature book ‘insulting’  Catholics:  To remain on syllabus

The High Court in Blantyre has  granted an injunction to the Malawi Writers Union (MAWU)  stopping the government though the Ministry of Education and Malawi Institute of Education from removing  from the MSCE Syllabus a Chichewa collection of short stories containing a story allegedly defaming Catholics.

Lawyer Kuleza Phokoso

Government released a notice addressed to all education division managers and other stakeholders in the education sector notifying them that the book titled Kusintha Maganizo ndi Nkhani Zina has been withdrawn from the list of prescribed examinable texts.

“The book has been withdrawn because it contains a story titled ‘Mdalitso Wabodza’ which is immoral in nature and portrays a damaging image of the Catholic Church. The Ministry of Education views the story as being insensitive to the Catholic Church,” reads part of the communication.

According to court documents of Judicial Review case number 80 of 2017 Nyasa Times has seen, Justice Jack Nriva granted the Injunction to Malawi Writers Union through private practice lawyer Kuleza Phokoso, pending Judicial review of the decision by the government to remove and ban the book from the syllabus.

The injunction restrains the Ministry of Education, Science and Technology and Malawi Institute of Education (MIE)  from removing the book, “Kusintha Maganizo ndi Nkhani Zina”  from the syllabus,  let alone replacing it with any other book.

According to the court documents, Phokoso argued that the decision to remove the book was made without a lawful and procedurally fair administrative process where their legitimate expectations are known, was made by wrong people and hence utra vires the Education Act and its regulations.

“It [the decision] was made in violation of rules of natural justice and through the abdication of MIE as the Ministry of Education does not have powers to remove, exclude, or include a book into the national curriculum and  that the decision to remove the whole book from the syllabus because of one story was unreasonable in the Wensbury sense and impropotional,” argued the lawyer.

The court order means that the book remains on the syllabus, remains examinable and students will continue to use it.

MAWU is seeking orders quashing the decision of the Government through the ministry of education to remove the book from the MSCE syllabus, and the sum of K320 million in compensation for the pecuniary losses they have suffered as a result of the decision.

Taxpayers are likely to cough the K320 million in compensating the Union for the wrongful decision of the government.

According to MAWU, they bid for the inclusion of the book into the syllabus in January 2017 and were told to remove certain stories by MIE’s evaluators after a grueling 5 months page by page evaluation  upon which it was approved in September 2017 to stay on the curriculum for a period of five years.

Civil Society Education Coalition Executive Director, Benedicto Kondowe,  expressed concern  that government did not conduct a good vetting process.

“When books have been written, there is that consultative process where the scripts are shared with stakeholders to ascertain if there are issues which need to be dealt with. I am of the view that government did not play its role well because it could have changed the words before the actual printing was done,” he said.

I agree with you Jesus is Lord. There is only one mediator between Man and God and that is Jesus who was killed and crucified by the Roman Catholic Church. Let us read about Mdalitso Wabodza as RCC freely read their pastoral letters that demean others and their institutions. Anthuwa ndi abodzadi!!! With their celibacy how many Roman Catholic priests are dying of HIV contracted through the breaking of celibacy? Anthu ankhaza amenewa, ozunza azimai. Catholic nuns always put on uniform while their male counterparts, the priests, akumakhwefula mutawunimu. Tawasiyeni ma nuns nawonso adziminula. VIVA MARTIN LUTHER, VIVA PROTESTANTS!!! Yeah but unfortunately there is not much difference. Luther remained Catholic but with changes. A true Protestant will admit they are essentially Catholic. One day they will return to Rome, the ecumenical movement is gaining pace. Anyway if you can, get in touch with Resurrection Baptist Church in Lilongwe, a righteous remnant. Search on YouTube for khulupirira.

I feel sorry for the DPP and its leadership for the war it has started with the Roman Catholics Church. I know MAWU is a sacrificial lamb, but this is utter retaliation of the DPP to what the church did by urging its followers to go to the streets in support of PAC demo. Peter has been ill-advised and this may be the beginning of his downfall. Mark my worlds, he will be like Joyce Banda who tested power for a few years and never returned to Kamuzu Place after the general elections. MCP tried to fight the Catholics in… Read more »

The story in the book is the manifestation that chisembwere chachuluka pakati pa ansembe ndi akazi amumpingo wakatolika. Too much hypocricy. Almost every priest has children or atleast has chibwezi. And priests akuthetsa mabanja aweni more than anyone else. The book MUST NOT be withdrawn.

Good, it is a church of Satan. How about adding Fox’s Book of Martyrs to the syllabus, to see just how brutally evil the RCC is? “For there is one mediator between God and man, the man Christ Jesus” (1 Timothy 2:5)

GRM, if you die today are you 100% sure you’re saved and going to heaven? There is only one way to be saved and it is not found in the Catholic Church. Video to show you from the Bible how to get saved one-time; in Chichewa on https://m.youtube.com/watch?v=I2pKKxhRHVY – in English https://m.youtube.com/watch?v=EAdRxXeFcZs … to quote the Bible to Catholics: “cone out of her my people!”

Actually Katungwe, the Bible TELLS us to judge. Matthew 7:5,16,20 – John 7:24 – 1 Corinthians 6. Jesus was angry with the Pharisees because they did not judge, Matthew 23:23

Good. For how long shall we pretend to be the holiest nation? Let the students read everything available. Gone are the days of tyrannical censorship boards.

When politicians begun to regard themselves as education experts, the quality of our education went downhill. And now NRIVA and PHOKOSO, who I assume are lawyers with MAU, want to influence what we teach…get out of the way! We have already lost decades and we do NOT need your warped sense of humor! How do we teach our pupils? To be defiant to the established order? To have sex with whoever they want?

NRIVA, PHOKOSO and MAU help to rebuild the education system! not continue sending it to hell…
