House worker jailed for sex attacks on two girls

Limbe Dalton Magistrates court has sentenced to 36 months (three years) Imprisonment with Hard Labour (IHL) Innocent Kanyesi for sexually assaulting two under-aged girls.

Kanyesi, 22-year old and hails from Mlozi village T/A Kadewere in Chiradzulu was arrested in June 2010 for defiling and indecently assaulting two girls (names withheld) in Naperi, Blantyre.

In mitigation before the judgment, Kanyesi pleaded not guilty to the two charges and asked the court to be lenient for he has already served jail time due to overstay in prison where he has been on remand since his arrest.

But passing her judgment, Magistrate Mary Mbekwani noted that cases of defilement and indecent assault were on increase hence the need for stiff punishment to curb the malpractice.

Mbekwani therefore sentenced Kanyesi to 36 month Imprisonment with Hard Labour, a judgment she said would send a warning shot to others.

And according to Police Prosecutor handling the case, Elton Chakhaza, Kanyesi will only serve 30 days.

“Since the sentence runs from the day of his arrest, that means that Kanyesi will be out of jail on June 20 this year for he has already served two years in prison as he has been on remand all this time,” Chakhaza explained.

Case Details

Information presented in court earlier on revealed that Kanyesi twice defiled the girls between 14 and 25 June, 2010 after coaxing them with K10 coins.

Kanyesi who was working as houseboy for one of Naperi residents, is reported to have taken advantage of the girls while they were playing around his master’s house.

He, on two occasions, coaxed the girls into his boss’s house and forced them to undress before forcing himself on them. On both occasions, Kanyesi gave the girls K10 coins and threatened them with death if they happen to reveal the incidents to anyone.

However, one of the girls’ parents got suspicious after noting that her daughter was having problems with walking. Upon questioned, the girl revealed the incidents that lead to the arrest of Kanyesi.

And medical report from Queen Elizabeth Central Hospital (QECH) exhibited in court confirmed that the girls were indeed defiled and indecently assaulted.
