Malawi cashgate convict jailed 3 years: First conviction on money laundering
Top tourism ministry official Treza Namathanga Senzani who is the first convict in the so-called “Cashgate” scandal that led to the suspension of foreign aid has been has been jailed to three years for offences of money laundering.
‘Cashgate’ denotes the systematic skimming of millions of dollars of money from the government payment system.

Trial Judge Ivy Kamanga passed her sentence on Tuesday after more than two hours of delivering her determination.
Senzani, accompanied by her husband and family members, sat calmly in the court as her sentence was being delivered.
Justice Kamanga sentenced Senzani to nine months for a charge of theft and three yrs for money laundering. The sentences will run concurrently.
The judge also ordered the forfeiture of her money and banks account to be taken by the State.
Justice Kamanga said on money laundering an option of K2 million fine cannot be exercised. She pointed out that despite Senzani being first offender, she does not deserve a suspended sentence.
Senzani pleaded guilty to stealing around $150,000 (63 million kwacha) from state coffers, part of a broader swindle worth at least $30 million and was convicted on her own guilty plea.
She was arrested last year after a probe found she issued two government cheques to her own company, which did not provide any goods or services to government.
‘Cashgate’ unravelled following the shooting of former Budget Director Paul Mphwiyo on 14 September 2013. Thereafter, huge sums of money in Malawi Kwacha, South African Rands and US dollars started showing up in unlikely places like car boots or under pillows as the suspects were avoiding formal banking since the unexplained money could have raised eye-brows.
At least 70 people were arrested and are currently facing theft, fraud, corruption and money laundering charges in courts.
Western donor nations, who bank roll at least 40 percent of Malawi’s budget, reacted by pulling the plug on the earmarked US $150m in budgetary support.
‘Cashgate’ is Malawi’s biggest financial scandal in the southern African country’s 50-year history as an independent country.

Don’t blame the judge blame the prosecutor. Why did he charge her with theft, a smaller crime, rather than theft by a public servant a very serious crime which attracts max 14 years imprisonment. The prosecutor has cheated us coz the convict is a sister of a DPP guru.

“3 years plus 9 months will run concurrently” what it means here is that this lady will be out of prison by mid next year coz the sentence will start from the day she was arrested plus the presidential pardon which she will get after showing remorse within the prison walls. I think it is better to steal K63 Million, multiply it through business and millions in interests, and return it after being caught, and keep the rest of the profits than working for years and retire with only K4 million.
What if each civil servant chooses that path of gambling public funds by stealing K60 million each with chances of being caught at less than 50%, and if caught you can return the money but still keep profits and interests gained from investing such stolen money after serving only 3 years in jail

I overheard officers saying “ahaaaa, now lets not steal K10 Million Kwacha because we will be jailed for over 7 years, what we should do is to steal over K100 Million Kwacha and be jailed for less than 3 years and thereafter, be released and continue to eat our money”. This is miscarriage of justice.
First of all she is charged with stealing K63 million only (same price as a rickety Prado).
Yet she has amassed so much wealth on her civil service pay to build two mansions; one in Lilongwe and the other one tucked away from public view on a huge farm in Phalombe.
Over and above that she furnished these properties lavishly and bought expensive cars.
The K63 million she is supposed to have paid back is a pittance of the actual amount she store from tax payers.
Secondly the so called learned judiciary (more like corrupt) give her a meagre 3 years for her industry, she will be out of jail in no time to continue enjoying her stolen money and property.
This judgement does not deter would be thieves from the public purse. The way things are now economically it will be worth it to steal as much as possible, be arrested and spend a well earned rest in prison as your stolen money accrues interest in banks, come out in a few months later and enjoy your loot.

I saw this coming! The conduct of the judge herself was very suspicious! How did she let the convict off on bail when she was awaiting sentencing? That’s unheard of. And then she kept on postponing the sentencing ruling for flimsy reasons or no reason at all. And finally the bombshell- a 3 year sentence and not the maximum 10 years. I would want the Chief Justice and Malawi Law Society to investigate this lazy judge because I smell a fish here.

My fellow Malawians, this Judge Ivy is not good and is one of most corrupt people. She presided over giving bail to the Mid Night 6, yet when the case came for hearing before her, she recused on the basis that her (Ivy Kamanga’s children) go to school together with Patricia Kaliati’s children. Does it sound that she is a justice of integrity?? Why not recuse in the first place??? Now she is giving a very fake judgement to Tereza. We have many cases on corruption involving less money people being given severe custodial sentences. Can someone justify you steal K63,000,000.00 and be given 9 months imprisonment? This is the greatest joke of the year from our judiciary. Can the state please appeal for the sentencing is just too lenient. It does not reflect the seriousness of the offence committed. Chief Justice remove all these so called “learned people” from Chanco and give the wig to guys from Mpemba (FGM, SGM & TGM) who can melt justice fairly without fear or favour. The judiciary is tell the whole world that in Malawi if you steal from government is ok, you will get scot-free judgement so that you can continue from where you stopped, hence sentencing you to 2yrs imprisonment

Only three years? What about the villa she built with cashgate money? Lutepo, Kasambara, Karonga, Manondo, Mphwiyo and all you thugs wait for your day! You can delay the justice but one day it will be melted on you! AT least a jail sentence is a lesson to the rest!
She built the villa towards the end of Bingu’s rule – in anticipation of the AU summit to be rented out to delegates as way of recouping the cost. Therefore the villa was not built with cashgate money since APM has emphatically defined cashgate as taking place between April and September 2013.
You may also want to know that the areas now known as New (or cashgate) Area 43 and ‘Nigeria’ section of Area 12 were actually started during Bingu’s time…as they say “You do the maths”!

I am not comfortable with period of her imprisonment. Only three years, by 12 midnight she will have only 2 years and 364. She could have been given even twenty years and above. Freezing only her accounts. What about her apartment worth millions of kwacha?

The three years is a different case..money laundering, i.e..-the process where the proceeds of crime ( the 63 million in this case) are transformed into ostensibly into other assets or ‘legitimate money’..so there are two cases here…….so people should get it clear that the theft of 63 million has only attracted 9 months of sentencing and three years is for money laundering but running concurrently…if it was theft of mk63m alone, she could only be serving 9 months!
