Malawi court dismisses case on Pres. Banda purported resignation letter: Dave Namusanya freed

The Lilongwe Magistrate Court has dismissed a criminal case in which Dave Namusanya was accused of authoring a purported resignation letter of President Joyce Banda advising the Speaker of Parliament that she could no longer execute duties due to alleged health problems.

Namusanya was accused of forgery and authoring a letter likely to cause breach of peace.

Magistrate Patrick Chirwa dismissed the case Monday morning after the defense counsel asked for the dismissal of the case under Section 247 of Criminal proceedings.

Chirwa ruled in favour of the defense as the State did not show up for hearing.

Namusanya, a graduate of the University of Malawi and critic of President Banda, was arrested and granted bail in May this year.

Police earlier arrested a 34 year-old Wells Tsidya Phiri in connection to the resignation letter.

In the alleged resignation letter, President Banda ‘claimed’ that she had decided to resign following a doctor’s advice.

State House dissociated itself from the letter before the Malawi leader, on her return from Equatorial Guinea, reacted angrily to the letter and put up K2 million (about $5 000) bounty for anyone who would provide information about the authors.
