Malawi man 75, jailed for sexual abuse on 11-year-old girl
First Grade Magistrate court in Malawi’s northern border district of Karonga has sentenced a 75-year-old man Bosco Cheyo to three years in prison with hard labour for sexually assaulting a 11-year-old girl.
The court heard that on August 11, 2014 at Ngana village in Karonga district, Cheyo took a girl to his house for treatment to a witchdoctor as the girl was sick but ended up assaulting her.
According to the girl, Cheyo took her to the witchdoctor for treatment but did not sent her back to her parents saying the man told her that he has married her.
However, the girl was rescued by members of the Women’s Forum.
“It was on 13 August that a received a call that a man has married a 11 year old girl because he helped her to recover from her disease of epilepsy and the father of the girl did not have the money to give the man instead gave the man her child,” said Martha Mkamisa a member of the forum.
Mkamisa said the girl told them that the man used to touch her private parts and breasts every night,” said Mkamisa.
Police prosecutor Sergeant Peter Machemba told the court that indecent assault is a serious offence which carries a maximum penalty of 14 years imprisonment with hard labor.
“The court needs to impose meaningful sentence to the convict to deter other would be offenders because indecent assault is very serious offence and also the young girl has been affected by the man’s behavior so a stiff punishment will be a reason to a man,” said Machemba.
In mitigation Cheyo asked the court to be lenient when passing sentence because he has a big family responsibility and that he agreed with the father of the child to marry her.
“You have to be lenient with me because I have a family to take care of and that we agreed with the father of the child to marry her only that now he has run away to give witness,” said Cheyo.
Passing sentence First Grade Magistrate Chakaka Nyirenda agreed with the state that indecent assault is a serious offence that carries a maximum penalty of 14 years imprisonment with hard labor but he reduced the sentence because he was the first offender and he also considered the age of the convict.
“It is true that these offense are very serious but because he is the first offender and very old I sentence him to three years imprisonment with hard labour.”
Cheyo, 75, hails from Mwayisondola village in the area of chief Mwakawoko in Karonga district.
