Malawi student jailed six years for sodomy: Pleaded guilty

The Rumphi first grade magistrate court has sentenced 21 year old Mathias Maweta a form four student at Phwezi Boys secondary school to serve six years imprisonment with hard labour after being found guilty of sodomising a 14 year old form one student from the same school.

Rumphi first grade magistrate Sophie Chimaliro convicted the student on his own plea of guilty.

Rumphi police station prosecutor Constable Malumbo Jere told the court that Maweta who comes from Mkwate village T/A Mulumbe in Zomba sodomized a 14 year old student (name shielded) on 27 May this year.

Constable Jere said the suspect sodomized the boy at around 21: 30hrs at the school’s football ground.justice

”The suspect took the boy to the school’s ground and had carnal knowledge with him. All this happened while the suspect threatened to beat the boy with a metal bar he was carrying,” said Constable Jere.

He said police visited the ground and found used condoms which they believe the suspect used in sodomizing the boy.

The police also managed to trace similar type of condoms in the suspect’s bag.

A medical examination conducted at Rumphi district hospital also confirmed that the boy was sodomized.

Police prosecutor told the court that the boy had suffered psychological trauma and asked for a stiffer sentence to deter would be offenders.

In mitigation the suspect pleaded for leniency saying he is a form four student who is expected to sit for MSCE exams starting on 26 June this year.

He said pleaded he was still young and would like to continue with his studies.

However the Magistrate quashed the suspect’s plea saying he should have known that he will sit for MSCE exams before committing the crime.

The Magistrate said the sentence would serve as a good example to other students who might be sodomising other students in schools.

Sodomy which is contrary to section 153 sub section (a) of the penal code attracts a maximum penalty of 15 years imprisonment with hard labour.
