Man caged 10 years for defiling girl enticing her with K20

Blantyre Magistrates Court on Wednesday convicted and sentenced to 10 years imprisonment with hard labour (IHL) Shadreck Kwilira for defiling a seven year old by enticing her with K20.

Kwilira 27 years old and hails from Ntenje village T/A Machinjiri, Blantyre was arrested on March 3, 2013 after being caught in the act in Zingwangwa township.

According to information police tendered in court and testimonies of five paraded witnesses, Kwilira who runs a battery-charge business in the township, has been defiling the girl (name withheld) on several occasion.

“The girl said on March 3, she went to Kwilira’s shop and begged for some money, instead he locked her in the shop and defiled her. It was one of the customers Pearson Chawinga who caught him in the act. The suspect was arrested and put on remind at Chichiri prison,” Police Prosecutor, Sergeant Elton Chakhaza told the court.justice

Sergeant Chakhaza said the girl disclosed to the law enforcers that Kwilira had been defiling her on several occasions and he gave her K20 each time after the act.

Medical examination results at Queen Elizabeth Central Hospital (QECH) One Stop Center show that the victim was defiled, and has bruises on her private parts.

Despite pleading not guilty to the offense, Senior Residence Magistrate Innocent Nebi found Kwilira guilty after full trial and convicted him accordingly.

In mitigation Kwilira complained that he was an orphan, he is asthmatic and has heart problem but Magistrate Nebi never hesitated to sentence him to 10 years for defilement contrary to section 138(1) of the penal code.
