Man jailed 16 years for sex assault on sister-inlaw

The Midima Senior Resident Magistrate Court on Tuesday sentenced Madaliso Banda, 32, to 16 years Imprisonment with Hard Labour (IHL) for rape.

According to Limbe Police Station Assistant Public Relations Officer (APRO), Widson Nhlane, the convict is married to the sister of the 20 year old victim (name withheld).

“It was reported that the grandparents of Banda’s wife fell sick in the village and he went to a witchdoctor in Mozambique who allegedly told him that in order for the sick grandparents and his in-law (the victim) not to die, the victim needs to sleep with any male person,” said Nhlane.

According to the police publicist, Banda narrated his story to the victim adding that her parents gave a go ahead that she can sleep with someone for her to save her life.

“The victim asked her boyfriend to sleep with her but he refused and it is at this juncture that Banda took advantage of the victim to have unlawful carnal knowledge with her,” he said.

According to the victim, Banda had carnal knowledge with her without her consent.

Later in January this year, it was discovered that the victim was six months pregnant and her parents denied to have been told about what Banda told her when he came back from Mozambique to meet the witch doctor.

Passing judgment, Magistrate Mangawa Makhalira, slapped Banda with a 16 year jail term to act as a deterrent to would be rapists.

The offence is contrary to Section 133 of the Penal Code.

The convict, Madaliso Banda, hails from Mmina Village in Traditional Authority (TA) Chimaliro in Thyolo.

It will be painful for the child to know the father after 16 years, and the child will hate one of the parents.
