Man jailed 6 years for ‘doggie’ sex assault on pupil
The Blantyre Magistrates Court on Friday convicted and sentenced Samalani Msiyambiri to six years imprisonment with hard labour (IHL) for defiling a six year old girl last year.
Msiyambiri aged 20, who has been on remand at Chichiri Prison since his arrest, hails from Mtenje village, T/A Machinjiri in Blantyre.
He however pleaded not guilty to the offense but First Grade Magistrate Ngaiyaye found him guilty contrary to Section 138 of the Penal Code, after prosecution successfully proved their case and sentenced him accordingly.
Msiyambiri is said to have tried to penetrate the innocent girl (name withheld) through in a ‘doggie style’ on July 05, 2012 in Mbayani Township after he failed to entice the victim and her friends with chips.
According Police prosecutor, Sergeant Eliza Kapalamula, Msiyambiri on July 5, at around 11:00 hours defiled the girl, a standard one pupil at Namiwawa primary school.
“They met the accused on their way home who asked to buy them chips. The pupils were frightened and started to run away. He however managed to catch the victim and took her to a certain old house that’s was previously used by Namiwawa head-teacher.
“He put her on his lap, removed her underwear, and tried to penetrate her through the back (chakumbuyo). The victim felt pain and screamed for rescue till a group of people rushed in. He tried to run away but was caught as he tried to cross a certain stream within Mbayani,” Sergeant Kapalamula told the court.
A verification medical and physical examination done by doctors at One Stop Center at Queen Elizabeth Central Hospital findings are compatible with attempted penetration and consistent with the police report.
