Mchinji man jailed 14 years for sexual assualt on 11-year-old girl

The First Grade Magistrate court in Mchinji on Friday slapped 42 year old Boston William with 14 years imprisonment with hard labor after finding him guilty of defiling an 11 year old girl.

The judgment has come following his arrest by the district police on July 6 after the girl’s mother lodged a complaint that she had been defiled.

Before the sentencing, the court heard through state prosecutor, John Mkandawire that the convict Boston William (42) on the night of 27 September, 2017 defiled the victim who he   threatened against disclosing the matter.

On the fateful night, the mother to the victim was in Kasungu attending a funeral service.

Mkandawire told court that a week later after the mother returned home, she observed some changes in her daughter as she was unable to walk.  After being questioned, the girl revealed the abomination.

The development prompted the mother to go to Mkanda police unit from where she was referred to Mkanda health center for medical examination.

After medical examination, the victim was referred to Mchinji district hospital for further checkup and the medical report confirmed that the convict defiled the minor and that the victim was diagnosed with blood syphilis.

It is said that the medical report from the district hospital forced Mkanda police unit investigator to drag the convict to the health center where it was found that he had blood syphilis.

On 13 November last year, the victim who was on treatment died after suffering from blood syphilis.

The suspect denied to have slept with the minor.

His worship Rodwell Meja Phiri after hearing testimonies from five witnesses with the help from Youth Net and Counseling (YONECO), he quashed the mitigating factors presented by the convict who pleaded for leniency in the sentencing. Phiri said testimonies were beyond the reasonable doubt.

The magistrate further expressed belief that the convict is behind the death of the victim

He then ruled that the convict should be jailed 14 years imprisonment with hard labor as the offence he committed was serious in nature.

Meanwhile the case has been referred to High Court in Lilongwe for further hearing. There is high expectation that the man can get up to 21 years IHL.

Boston William hails from Katema village in the area of Senior Chief Mkanda and was answering to a defilement charge which is contrary to section 138 of the penal code.

Within the month of January this year, Yoneco has already registered six defilement cases in the areas of Traditional Authority Mlonyeni and Mkanda.
