Mulli insists Judge Mtambo should not handle his Malawi Savings Bank case
Mulli Brothers Limited is still insisting that High Court Commercial Division Judge Michael Mtambo should recuse himself from presiding the case between the company and Malawi Savings Bank (MSB) on allegations that the Judge received a bribe from the bank.
The State-owned MSB claims that Mulli Brothers took a K3.2 billion (about $8m) overdraft and is fighting repayment of the loan in court.
However, Mulli Brothers is challenging the figure, describing it as exaggerated and applied to the court to be allowed to bring before court auditors Johnson and Wilson to provide forensic audit evidence.
Mulli lawyers Dick Chagwanjira and Chancy Gondwe, also asked the court for a referral to the Chief Justice to determine whether the arguments raised in the case are constitutional in nature and should be referred to the Constitutional Court.
On Tuesday, Justice Mtambo was about to male a ruling about case referral but lawyer Gondwe told the court that he had appealed to the Supreme Court of Appeal against the judge’s refusal to recuse himself .
Mulli Brothers is owned by Leston Mulli who was accused of monopolizing business during the late Bingu wa Mutharika regime.
