Mzuzu sex offender jailed 16 years

Mzuzu Magistrate Court on Thursday sentenced a 29 year old man to 16 years imprisonment with hard labour for defiling a nine-year-old girl.

The court heard that Joseph Gomani Banda defiled the child on 15th June, 2016, at Sonda Location in the city when he met her on one of the roads in the location.

It was further reported the accused forcefully dragged the girl to the nearby uncompleted house where he defiled her. She then later narrated the whole ordeal to her parents who later reported the matter to Luwinga Police.

State Prosecutor, Assistant Superintendent Betty Msowoya, told the court the suspect gave the standard three victim K100 soon after he defiled her to conceal the matter.

Banda pleaded not guilty, prompting the state to parade five witnesses that included a medical practitioner who wrote a medical report confirming that the defilement took place.

Although the accused pleaded for a soft punishment claiming that he is a bread winner, the Chief Resident Magistrate Texious Masoamphambe, concurred with submissions of the state that such people are dangerous to girls in the country.

He therefore proceeded to sentence Gomani Banda to 16 years imprisonment with hard labour which is contrary to Section 138 of the Penal Code.

Joseph Gomani Banda comes from Diyala Village in the area of Traditional Authority Kawamba in Kasungu District.
