Sex offender jailed 6 years for impregnating grand-daughter, 12

The Kasungu First Grade Magistrate’s Court on Monday sentenced a 67-year-old man of Kapichira Village, Senior Chief Chulu in the district to six years imprisonment with hard labour (IHL) for defiling and impregnating his 12-year-old granddaughter.

Kasungu Police Public Relations Officer Sub Inspector Edwin Kaunda said the convict whom he identified as Phillip Banda committed the offense during the month of December 2011.

According to Kaunda the court heard that the victim’s parents were away in Nkhotakota where they stayed for seven months when the incident occurred.

He said the victim (name withheld) together with her two brothers were at the time under the custody of their grannd father  who stays at Kholowa Village in the same area.

“One night the convict went into the house where the girl was sleeping and coaxed her to have sex with him. But when the girl refused the convict forced himself into the girl and defiled her,” he explained.

Kaunda further said after the incident the grandfather promised to give the girl K200 for her not to reveal the matter and warned that something bad would happen to her if she dared reveal the ordeal.

He said the beans were however spilled when on return this month the parents discovered that their daughter was seven months pregnant. She was in standard six at Juwi Primary School in the district.

“The father asked her about the pregnancy and it was at this point that she revealed that her grandfather was responsible,” added Kaunda.

Police arrested Banda on July 24, 2012 after the parents reported the matter to Kasungu Police Station.

He was charged with defilement which is contrary to section 138 of the penal code.

He is said to have pleaded guilty to the charge when he appeared before First Grade Magistrate Hens Kantchere.

“The State Prosecutor Sub Inspector Manase Banda pleaded with the court to give the convict stiffer sentence because what he did has destroyed the future of the girl,” said Kaunda adding the Magistrate however sentenced the convict to 72 months IHL considering his age.
