Sexual assault on pupil earns 58yr-old-man a 4 year jail term

A court in Malawi’s eastern district of Balaka has sentenced a 58 year old man to four years imprisonment with hard labour for defiling a 12-year-old school girl.

Police Prosecutor Sergeant Yohane Chaomba told the court that the convict John Kambale defiled the orphaned school girl early April when she went to the man’s house to beg food.

“On this day, she had nothing to eat and thought of going to the suspect to beg for food only to be told that he would give her the food on condition that he has sexual intercourse with her. Considering that the girl had nothing to eat, she consented and they had sexual intercourse,” Chaomba told the court.

After some days the victim started feeling pain from her private parts and this forced her to reveal the ordeal to her neighbours who reported the matter to Ulongwe Police Unit who later arrested the suspect.

Medical examination conducted at Machinga District Hospital revealed that the girl was really defiled.

The suspect pleaded not guilty but the court found him with a case to answer after Police paraded four witnesses including the investigator Detective Sergeant Billy Kammera.

In his submission, Prosecutor Sergeant Chaomba asked the court to consider giving the suspect a stiffer sentence considering that these cases are becoming common in the district.

He said it is sad that the suspect took advantage the child’s challenge to fulfil his needs.
In his mitigation, the suspect asked the court not to give him a stiffer sentence considering that he is sick and aged.

Passing judgement, First Grade Magistrate Damson Banda agreed with the state that these cases are becoming rampant in the district.

He said it is unfortunate that people who are supposed to be protecting our girl child are now becoming a threat to them.

The Magistrate therefore sentenced him to 48 months imprisonment with hard labour so that it should be a lesson to him and would be offenders. He said he has given him such a sentence considering the age and his healthy condition.

John Kambale comes from Ngasale village, Traditional Authority Amidu in Balaka district.
