Magistrate Viva Nyimba slaps robber lengthy prison sentence

The Blantyre Magistrate Court  has sentenced  a convicted robber Steven Nkhoma to lengthy prison term after being found guilty of robbery with violence which is contrary to section 301 of the penal code.

The court heard that Nkhoma, who was a Kanyenya seller at Bwandiro, attacked a Malawi Communications and Regulatory Authority (MACRA) official at the MACRA offices on November 28, 2014 when the official was coming from the bank.

The court further heard that Nkhoma alongside four other men grabbed the lady after threatening her with a gun and snatched from her K3.5million and a car which was later recovered.

The court heard that Police later spotted Nkhoma in Lilongwe he was quickly arrested and later sent to Blantyre while the other four suspects are still at-large.

Senior Resident Magistrate Viva Nyimba said he slapped lengthy jail term for the horrendous, savage and barbaric crimes Nkhoma committed.

Magistrate Nyimba said Nkhoma needs to go to prison and serve for 15 years in prison with hard labour in order to deter would be robbers.

Nyimba said the robbery cases are becoming rampant now and that there is great need to protect the society from the robbers.

    ITS SIMPLY, IF WE WANT TO GET RID OF THUGS IN OUR COUNTRY, THE JUDGES HAVE TO PASS 20+ YEARS FOR THESE CRIMES, THEN THEY WILL BE AFRAID TO COMMIT THESE CRIMES. SO SIMPLY PUT “OUR JUDGES ARE JUST NOT HELPING US AT ALL”. SECONDLY WANT IS HARD LABOUR? WHAT DO THEY DO AT HARD LABOUR, ANYBODY KNOW? AND LASTLY CONVICTS WITH LESS THAN A YEAR, I HAVE SEEN IN OTHER COUNTRIES, THESE PEOPLE A MADE TO CLEAN DIRTY PLACES IN THE TOWNS LIKE RIVERS, DAMPING SITES ETC. GOVT SHOULD USE THEM TO HELP CLEAN OUR CITIES.

    I THINK DEFINITION OF A SERIOUS CASE VARIES FROM ONE JUDGE TO ANOTHER. ONE DEFINES STEALING 3.5m at GUN POINT AS BEING MORE SERIOUS THAN STEALING MK63+ SYSTEMATICALLY FROM GOVT!!!!! MA LOW YA A PAMALAWI

    This is what we call justice. Armed robbers need to spend more time in jail. It also sends a good message to other robbers, not the 5 or y 7 years that other judges give.

    I hope other judges will emulate the example of Viva Nyimba. His name also says it all! Uli umaphwa. You can even work in South Africa.

    Do we not have 30-50 year sentences in Malawi? My worry is these people are being given ARVs in prison thereby prolonging there life and are coming out of prison a live to reoffend again.
