UTM lawyers file court submissions with errors

The Constitutional Court hearing the elections case has extended time for Malawi Electoral Commission (MEC) and President Peter Mutharika to respond to submissions after UTM Party lawyers sent an electronic copy of the submissions to them which had errors.

UTM Party lawyers have filed  final submissions to the Constitutional Court challenging the re-election of President Peter Mutharika in May

The lawyers for MEC and Mutharika have since been given up to Sunday, December 15, 2019 at 10am to submit the written responses instead of December 14.

“… been informed by the 1st petitioner that the electronic copy of their final submissions which was served on the respondents had errors and has since been replaced,” reads a notice from the court.

The court said the decision was arrived at because the lawyers for the respondents had already started working on the documents which had errors.

This follows just days after UTM lawyers were slapped with a K600,000 for delaying in serving the submissions to the court and the respondents.

The submissions by first petitioner Saulos Chilima and second petitioner Lazarus Chakwera, losing presidential candidates for UTM and Malawi Congress Party (MCP), respectively, have leaked to the public ahead of their submission in court, with oral submissions set for next week.

The submissions focus on irregularities that occurred in the election and how MEC failed to remedy those irregularities as required by law, saying the electoral body failed in its constitutional obligations.

What type of writing is this, Mr Owen Khamula? You had all the time to find out and tell us which errors were in the submission, were they substantive? and why should UTM submission errors warrant an extension of a whole day, kuzolowela kuba basi? Those of us who have critically read the 41 paged submission by UTM found it well summarized and with a lot of substantive evidence bordering on illegalities and irregularities by committted by the DPP led MEC”. The Kenya election case of 2017 has been well cited by the learned Dr Chikosa Silungwe led UTM lawyers.… Read more »

If you read your nine word sentence you will not that has an error. And you expect a document more than 20,000 words to be perfect ?

@ Peter T is typical Mbuzi, UTM supporter from Bangwe. Can’t express themselves coherently, even in Chichewa or their own vernacular, and just nods their heads to everything, including ideas on the economy Chilima just gets from dreams or while having a shower.

This is interesting……….So it is possible to make errors and the time they have been given is to correct those errors so for you it’s possible but for others it’s rigging…….following.

Hehehehekkkkki. This is for Malawians to know that Chilima has no case, he is a big thief. Remember he openly told Malawians that he was the one who helped APM to rig the 2014 elections. God is clearing a smooth path for a chosen one “Rev Dr L Chakwera.” Very soon Chakwera will get his position as State President of Malawi…. Super Hi5 all the way!!!!

Initially we thought the delay was them trying to perfect their submissions, but nay…these guys are losing it. If the opposition will pull it, then it’s the MCP which have contributed alot. The UTM folks aren’t at that level. Anyway let peace prevail.
