ConCourt confirms judement day Feb 3 in Malawi election case

The Constitutional Court  has announced that it will  deliver its landmark ruling in the presidential election nullification petition case on  Monday February 3 as earlier reported by Nyasa Times.

Who wins?

The five-judge panel comprising Healey Potani, Ivy Kamanga, Dingiswayo Madise, Redson Kapindu and Mike Tembo will deliver the ruling on a deadline  say  on the case, which sparked violent protests since last year.

“Take notice  that the full  Court shall deliver  its judgement in this matter on Monday the 3rd of February, 2020 at 09.00 in the forenoon at  Lilongwe District Registry  of the  High Court of Malawi,” reads a notice of delivery of judgement by High Court of Malawi and Malawi Supreme Court of Appeal registrar Agnes Patemba

To ensure peace and order prevail, the Judiciary is working with the security agencies  – Malawi Police Service and Malawi Defence Force – for special arrangements on the judgement day.

Malawi Law Society (MLS)  president Burton Mhango said the society could have loved if the judgement was delivered in form of a summary rather than reading it out in its entirety.

Accredited media houses such as Times, Zodiak will broadcast live the ruling.

In the case, two of the presidential candidates in the May 21 2019 Tripartite Elections—UTM Party’s Saulos Chilima (the first petitioner) and Malawi Congress Party (MCP) candidate Lazarus Chakwera (the second petitioner)—want the court to nullify presidential election results over alleged irregularities, especially in the results management system.

Incumbent President Peter Mutharika of Democratic Progressive Party (DPP), who was declared winner of the elections, is the first respondent with Malawi Electoral Commission (MEC) as the second respondent.

Any party to the case can still appeal the Constitutional Court ruling in the Malawi Supreme Court of Appeal which will be the final arbiter in the matter.

  1. Thanks so much for the annoucement I hope things will be put to REST now we more than tired of this ROTTEN POLITICS in Malawi. The late President Hastings Kamuzu Banda once said, ‘My fellow Malawians since you have voted for DEMOCRACY expect nothing else but WAR’!!!!!!! Alas!!!! May his spirit RIP – surely since that time up to now I see nothing good but fighting after fighting……. Now the question is WHAT WILL HAPPEN IF THE CONCOURT rules in favour of Chakwera and Chilima?????? Secondly what will HAPPEN if the CONCOURT rules in favour of PETER and MEC?????? Fellow Malawians let’s spiritually come togather in prayers and ask GOD to sit in the midst of these judges because it’s only him who an give us the right judgement or else we all perish. But I do know that our GOD still LIVES and he is still with us in these difficult times. May HE forgive us our SINS and deliver us from the day of calamity, may HE remember Malawi and his faithful servants who cals upon his name in the day and in the night – we as faith servants of GOD called by HIS name we declare and decree PEACE in Malawi. and let the evil one be brought to shame!!!!!!! Amen!!!!!!

  2. Malawi judiciary is so corrupt that they even don’t know how to deal with such a rot. What happened to Ben Phiri lying under oath or Chaponda with all his rap sheep of criminal offences. Policemen who investigated Njauju murder have disappeared with evidence. Chasowa murder. ADMARC illegal sale of maize. Dubious sale of land. Dubious fires at government buildings. Kaliayati corruption case. Kasaila’s pornographic video. Bingu’s Grey trust probe. His wealth overseas and how he accumulated it. All these are few of cases sitting within the mandate of judiciary. People who are meant to administer the law. They work hard on where they know they will have kick backs. Believe you me, some of the judges in Concourt have taken kick backs. People will resort to violence if they perceive they’re being taken as fools.

  3. . Let’s remain focused to the ConCourt judgement which matters more than these games with Mpingagira that ACB, the judiciary and APM are playing .
    At worse Mpingagira will have to sleep in a police or prison cell eating food sent from his house and sleeping on a mattress sent from his house but only until after ConCourt judgement when he will be released. But expect him to get bail today.
    Malawians please,please, please, please focus on 3rd February. That is the judgement which matters. Mpingagira’s arrest and any other arrest ACB carry out is simply a side game. Don’t play this game. Remember focus on the ConCourt judgement nothing else matters not at this time everything else can come later.

We need Leadership that appoints people in high offices and Foreign Missions based purely on merit; not based on ill-intentions how they could maximise syphoning the resources of the country that come from Taxes of the hard working Malawians.
