Guilty and convicted for car park sex act in Malawi

Blantyre Water Board (BWB) internal auditor and a woman accused of sexual activity at Mwaiwathu hospital car park on Tuesday pleaded guilty to the lewd act when they appeared before Blantyre Magistrate Court.

A 26-year-old BWB employee, Thokozani Maluwa and 20-year-old Emma Peter, currently remanded at Chichiri Prison, were convicted on their own plea and will be sentenced Wednesday.

The two appeared before Principal Resident Magistrate, Innocent Nebi at Blantyre Magistrates Court after spending two nights in police custody.

They were caught by a night-shift guard while ‘in the act’ in a Nissan Tida BU 2489 parked at the Hospital’s car lot.

Maluwa and Peter were charged with Idle and Disorderly under Section 180 of the Penal Code.

The offence attracts a maximum fine of K1, 000 in default three months imprisonment with hard labour (IHL) for first offenders and K3000 or six months IHL for subsequent offenders.

The Ndirande Township residents told law-enforcers, during interrogation, they found the hospital’s car park
idea for ‘car sex’.

  14. We are following British laws which got changed so we are stuck in the 60s. The charged now reads ” public disorder”. This is so to avoid couples being arrested for having see in their private places I.e cars in private car parks ..it’s only unlawful act if it is done in public. Public is the ” world” we all know that it is not unlawful to have set in your car in your garage or mpanda where there in no ” public “. The act isn’t illegal boz it was in a ” car” or car park , it has to be proven that it was done in ” public”. Should we really handcuff and remove from society such personal and put in jail or prosecute in court..is our criminal justice or police system that efficient. Lesson learnt you’ve got to pay the right fee to the watchman if you want some private moment in most of such places in Malawi. Maybe the car was detained but as for the police to rapid respond I think we should not forget that even prisoners do have the right to sex do not criminalize harmless sex just as you are criminalizing alcohol
