Justice Kenyatta Nyirenda of the High Court in Blantyre has allowed assistant director of youth for ruling Democratic Progressive Party (DPP) in the Southern Region Godfrey Mussa and his accomplice charged with murder to walk free on bail.

Mussa and his partner Madalitso Kamwiri were arrested late last month on suspicion that they murdered 28-year-old Peter Kagulo, a resident of Chilobwe Township in Blantyre after a drinking spree.

But Justice Nyirenda granted bail to the murder suspects with reporting conditions to police every fortnight on Mondays and surrender their travel documents to police.

He also bonded the murder suspects to K10 000 cash each, K10 000 non-cash bond.

Justice Nyirenda also directed that each time the two wish to travel out of the country, they should inform police about their destination and duration of stay.

Mussa comes from Jolo Village, Traditional Authority (T/A) Bvumbwe in Thyolo District while Kamwiri is from Ziyaya Village, T/A Kanduku in Mwanza.

  14. Any suspect has the right to be given a bail. It doesnt matter wherever he comes from. Every suspect is innocent until proven guilty.

  20. They have been given fewer conditions because one suspect is coming from Lomwe District and very loyal to the ruling party. No wonder. The judge is protecting his job.

  22. I have said it b4 n will say it again..Our courts are a source of shame and all the problm w r facing. W hv seen armed robber being given bail for a song and they go on to rob us again and again and again. This is a clear case of robbery and murder n possession of stolen property is a criminal case in Mw. Is th girlfriend answering this charge in 1 of our so many incompetent courts? They r too corrupt to administer justice. I dont refuse that u r innocent until proven otherwise and also that every Malawian is entitled to bail bt the public interest is always a namba 1 consideratn when giving bail to suspects. MK10,000 for a murder suspect and a fortnight reportng to police smells really bably. I can happily say that this justice? is like so many of them. Corrupt and unshamedly so. Can I humbly ask Nyasa to dig a bit deeper abt his dealings? Its worthy digging and an expose can follow. Malawi does not deserve people of Nyirendas caliber. Shameful.

  30. It is true for a murder suspect to be granted bail on k10000 bond? Is this judge serious? Why sympathising with them? Mwina there is something behind the curtain

  34. These kind of issues undermine the rule of law. we do hope that the date for the trail has been set. When Umodzi Party says that we should have a time limit for bail, they mean these kind of issues. If this case will be concluded in 3 – 6 months then there is no problem, but if this will be as with other such cases, Malawi has a long way to deal with crime and anarchy is likely to be part of the nation.

  45. It is normal in any democratic dispensation that every suspect is deemed innocent unless proven guilty by a competent court of law and by a competent judge not of Kenyata’s calibre. If Kenyata was a wise judge he would have recused himself from handling the case citing his last ruling in favour of DPP which never won the elections otherwise no matter what kind of crime you face including treason bail is guaranteed unless you are fright risk and the prosecutors should prove beyond reasonable doubt that the suspect is not worthy bail. The problem we have in Malawi is that once a person is granted bail we think he is innocent which is totally wrong perception.

  61. Even a murder suspect is presumed innocent until proven guilty by a competent court of law. A judge does not deny someone bail just because he is suspected to have committed the crime. Nyasatimes is really foolish to have written this article. How many suspected criminals are on bail; ever wondered why Kasambara is on bail despite being accused of attempted murder of Mphwiyo? Malawians commenting here on political lines should also censure Nyasatimes for its flagrant lack of objectivity against DPP.

  65. The High Court has unlimited original jurisdiction under any law and there is nothing wrong here. Ngati simukudziwa mudzifunsa kaye osati kulongolola and start politicizing matters.

    My advice to the DPP led govt is that since under this govt it is acceptable for murder suspects to be released on bail, let all remanded murder suspects (thousands of them) also be released on bail. After all, the prisons are congested!
