Judge Mtambo revokes bail of Kasambara: Orders his remand to prison

Judge Michael Mtambo has revoked lawyer Ralph Kasambara’s bail on conspiracy charges and ordered that the former justice minister should be remanded to prison immediately.

Mtambo sitting at High Court in Lilongwe ordered revocation of bail  angered by Kasambara application for the judge to rescue himself from the case of shooting former budget director Paul Mphwiyo, saying it was just a delaying tactic.

The Judge also said Kasambara and co-accused MacDonald Kumwembe were threatening the judge himself and state witnesses hence his revoking the bail on security grounds.

Kasambara was cleared of the charge of attempted murder; however the judge had allowed the charge of conspiracy to commit murder to proceed.

The Judge however said the State has made out a prima facie case against attorney Kasambara on conspiracy to murder which the lawyer needs to defend himself.

Kasambara has applied for stay order that his confinement should start on Friday as he has “some personal issues” before then.

  4. Principles of natural justice have not been followed by both the DPP and Justice Ntambo. If RK was a threat to the security of Mtambo DPP should have brought the matter before another judge. Here Mtambo is both a prosecutor and a judge in a case involving his interests eg security and cv.

    Mtambo has confined that he is both a prosecutor and a judge in this trial of the trio. It’s no longer a secret before all of us that they will not get fair trial.

    A call for mistrial is worth mounting by all learned lawyers.

No justice for the poor in this world. As much as I am aware that the judge needs to remain neutral I believe his life or something is threatening his security. I would not dismiss that.

Here is a judge who wants to act as prosecutor and at the same time as a judge. judgè mtambo nowhere in this world can a judge conduct himself in this manner. ma temper akuonekeratu. let the state do its job and focus on yours. I am of the view that you are being played hard. At first they forced u to issue contempt of court on kasambaras friend and you did it without seeing it. Your emotions are overshadowing your reasonableness as a judge. don’t you think by contempt of court you gave kasambara room to prepare himself. Now you are at it again ,yes he will be there in remand on Friday and on saturday he will be out. Somehow Ralph knows u are emotional and he is using it as a tool to take advantage of you. Just wait till he embarrasses you big time. He is a genious and that is why he z going to get away with this before your very eyes. state prosecutor DPP to me seems relaxed and instead you are doing everything on their part and that will be difficult for you to sit as a judge and prosecutor .all this gives Ralph a step ahead. search me Malawians.

I’m no lawyer or an expert at law but my gut feeling tells me if Kasambala can establish that the judge has acted on emotion throughout the proceedings in the court he could ask for a mistrial . Judges are custodians of justice and therefore must exercise fairness in every ruling. As someone already said here a defendant has every right to ask the judge anything if they feel their case is being jeopardized. I am not here to back Raph or anyone as a matter of fact whoever is guilty know it in their heart and they can evade justice here on earth but can never do so before God. A defendant has right to employ every tactic in court that could help them out. We are talking of life and death here, and yes Malawi prisons are death traps. Am I right here you experts at law?

  58. The decision by the judge is based on emotions, not professional. He’s just angered that Kasambara asked him to recuse himself, a right that anyone answering charges can make if they feel the one presiding over their case is compromised. Mtambo already has a guilty verdict on Kasambara and crew. But as judge he ought to be neutral. But here is a judge who asked the state to find out if he himself could move to revoke Kasambara’s bail. I’m not saying Kasambara is clean, no. But he innocent until proven guilty without reasonable doubt. So let the justice systems work as supposed to. Not going personal about it

  76. Surely, Kasambara judgment was wrong to represent himself in a case like this one. His professional judgment got so compromised in the processes to the extent that he could not even read between the lines that his mere engagement with the judge in a war was a losing battle. One does not have to be a lawyer to have correctly read the situation. He(Kasambara) crossed the line. Period. There are also some pointers in this case that judge Mtambo and Ralph might have some old issues to sort out amongst themselves.
