Lutepo gets 11 years jail for Malawi cashgate

High Court Judge Redson Kapindu from Zomba Registry has sentenced up to 11 years imprisonment chief cashgate convict Oswald Lutepo.

Lutepo, who was convicted on his own plea of guilty to two counts of conspiracy to defraud government and money laundering, looked grumpy after the sentence was handed down to him.

The convict,  who has been using a wheelchair since December last year, addressed reporters in court before his sentence was passed, still implicating former president Joyce Banda (JB) , claiming the former president used him to siphon K4.2 billion kwacha from public coffers.

Lutepo, 37, was already a billionaire when he joined People’s Party (PP) in 2013 as director of recruitment. He previously was member of Democratic Progressive Party (DPP) where he made most of his fortune including buying Naming’omba Tea Estate.

He addressed a news conference like a VIP that he has no criminal mind and that cashgate crimes was political.

“Joyce Banda used me. She knows how she used me,” claimed Lutepo to reporters.

In a prepared message to reporters, Lutepo who was with his relatives, well-wishers, police officers and his lawyer Oswald Mtupila said JB should know that “love is more important than anything else. Using someone is a sign of lack of love,”

Lutepo was still adamant , claiming he is “ a good role model to the youths.”

He said: “ I was able to contribute to the country’s development by offering employment. I did not get rich because of cashgate, I had businesses before.”

Without shame, the cashgate prisoner said: “I insist, my conscious is clear that I didn’t steal from government. How could I get hold of government money on my own? The money was  for them,”

Lutepo has since pledged to fight for minority rights in prison including homosexuality.

  45. It is possible that the government should establish a special court to try all these CashGate cases. Please my appeal to ACB please get down to the root of this Cashgate. The Problem is not the JB but Officers who were given the responsibility of protecting the public funds. This should include the Minister of Finance, PS Finance, Governor of the Reserve Bank and his Deputies, Account General and Senior Staff at Account General. If we do not take these people to count we are just scratching the problem on the surface or we are treating the symptoms not the disease. Many people still have lots cash that they illegally obtained from Government and when the Cashgate cases are over they will start using the money. Alternatively the government should change the currency so that those who are keeping the cash should come out

I am made to believe that Lutepo was stealing government money but at the same time I am thinking how possible that a civilian can steal money from account number one. Lutepo could be imprisoned with some other people, for example, the people who authorized these transaction, people who signed sensitive documents like payment vouchers and checks.Lutepo could be only imprisoned for the money laundering where he was making stolen money legitimate unless we Malawians we do agree that payment in the government is very weak. In 2006, he swindled the National Herberium and Botanical Gardens in Zomba about 3 million kwacha for supplying them a second hand toyata hilux single cab which nocked off about 2 days of its operation and for supplying them a tractor. He used the same International Procurement Service company to swindle the parastatal’s public funds. He used to connaive with other senior members of staff to defraud the parastatal.

    If you want to know more about this issue, please contact the bosses of this parastatal. So, Mr Lutepo should not lie that he had no cashgate criminal before and in his mind. He started this cashgate life style sometime back when he was still young.

    To me 11 years of IHL is too little taking into account the cashgate life style that you have been living on all this years. Shame on you Mr. Lutepo as your wealth was not accumulated wuth clean hands. No wonder that you ran away from DPP when it was out of power and after cashgating with DPP gurus and joined PP because that was where your butter was.
