Mtambo still in hiding as police justifies arrests of HRDC members

Human Rights Defenders Coalition (HRDC) chairperson Timothy Mtambo is still in hiding following a warrant of arrest issued for him and the police say they were still looking for him.

The police say Mtambo and the two other arrested HRDC officials Gift Trapence and MacDonald Sembereka are facing charges of inciting people to hold demonstrations at state residences.

National police headquarters spokesperson James Kadadzera said their case stems from their statements they made last week to shut down state residences.

“They are aware that section 103 of the police Act prohibits  any demonstration or assemblies within a hundred metres from state residences unless the same has been permitted by the state president,” Kadadzera says.

He said this provision of the law had been brought before Mtambo and the other officials before when they attempted to demonstrate at state residences.

He said section 124 of the penal code prohibits any person to incite or solicit another person to break the law.

“By inciting people to seal the state residences on 25 March, 2020, the three committed an offence under section 124 of the penal code,” said Kadadzera.

Trapence and Sembereka were arrested on Sunday just hours after President Peter Mutharika vowed at a rally to deal with the HRDC over its decision to shut the state residences.

Malawi is too small for someone like mtambo to hide unless you say is out of the country Malawi yes will agree with you that maybe he’s hiding. Just do as what you master Peter advised you police to do at njamba DPP/ UDF alliance Lally so that he should not fire Jane Ansah and the rotten electrol commissioners including signing up for the reform bills for presidential election to come 50+1 .

This is a total lie from DPP/police Timothy mtambo is not a criminal and have never committed any criminality cases to run away he’s just preaching the rights of citizens of Malawi to which the DPP/police are against of. I never heard mtambo telling people to go breaking into other people’s property those doing that he always asks for the police to deal with the criminality according to their job. He always tells the people to march peaceful and give their petitions like what the constitution rights of the people to march peaceful says. So you DPP/ police hate the truth. The police are working for DPP not Malawi this is why when DPP tells police what to do they’ll follow what instructed yes boss. Malawi is for all not regions parties religion. Mtambo is not hiding and won’t hide liars. If DPP asks you police to throw teargas on peaceful matching what would you expect from the people matching?

  14. Its a sign that Mtambo was being used by MCP and UTM, Ngati Mtambo ndi dolo akubisala chani? He must face the arrest, go to Court and akanene mfundo zake kumeneko. True freedom fighters dont fear an arrest. This is an indication that the guy was being used.

    1. Kasambara is the link to bribing constitutional court judges. How can the judges say ‘majority’ is 50+1 when we have not used that since 1994? So were all the presidents illegal?

Where are we going to express our freedom of speech if this so called democracy is undermined by the DPP government whose readership showingly the rhythm of the dictatorship by Author Peter Wa Muthalika. No we back in square one again guys like those old days when silence was every day song whether things went wrong or right we had to shut up our mouths. I feel sorry for and cry for my lovely 🇲🇼.   26. But why arresting them only yesterday following the DPP gathering at Njamba, when they said this last week? Are you telling me that the Police were waiting for a go ahead from APM for an arrest? What about the DPP gurus who went to demonstrate at state house in Lilongwe, have they been arrested as well? I am sure the gurus were within 100 metres from the gates of state house. I can conclude that this is political persecution and DPP wants to instill fear to the opposition so that they don’t campaign freely.
    I only expect arrests once the state house gates were shut down, and I am sure that the HRDC wanted to hold vigils at the entrance of the state house.

Did they say they will shut down state residences buy physically being at the doors of the said state residence or they will shut down the residences by closing the roads leading to the state residences which can be done within the confines of the law? How I wish you could personally pay for the damages you are carelessly inviting upon the tax payers.
    This is tantamount to abuse of state organs by the DPP thugs and its my hope that one day, one day, DPP and its thugs will answer and pay for their crimes.

    2. True, state residences can be shut down within 100 metres if 100,000 demonstrators surround them. So there is no criminality in the statement. Shutting them down legally is possible!!!!!!

  31. someone is hiding him, very unpatriotic. mtambo should know that resisting arrest is an offence better surrender quickly so that he is processed according to law.
