Mzimba man go in six years for sex assault
The Mzimba First Grade Magistrate Court has slapped a 21 year old man with a six year jail term for sexually assualting a 15 years old girl.
Mzimba Police spokesperson Sergeant Gift Nyirongo said the girl (name shielded) met her fate when she was coming from a sports session at Watereka Full Primary School where she also learns.
The convict, Satiel Nyirongo, 21, of Lukhwawa village,Traditional Authority Mzikubola, asked the girl to wait for him.
“Since they were somehow related and came from the same village, the victim stopped. But when Satiel arrived he just grabbed her and dragged her to a nearby bush where he defiled her and ran away,” the Police publicist said.
However, a medical report from Mzimba District Hospital did not show that defilement took place because the girl was delayed for days as the village Headman did not want to report the case to Police.
Despite the negative report, the State, represented by Sub-Inspector Alfred Makiyi managed to convince the court that defilement took place.
Magistrate George Longwe said that it was very unfortunate that while government and other stakeholders were working tirelessly to safeguard children, there were still some ill-minded people who continued to abuse them.
Longwe said the convict needed a custodial sentence to serve as a deterrent and also give him an opportunity to reform.
Cases of defilement have become rampant in Malawi with hardly a day not passing by without hearing reports of girls either sexually attacked or being coaxed in sex.
Malawi’s Penal Code, section 138(7), defines defilement as unlawful carnal knowledge of any girl under the age of 13 with or without her consent. The offence attracts a maximum sentence of 14 years imprisonment with hard labor.
