Tobacco tenant jailed 10 years for sexual assault
A tobacco tenant who worked at Choma in Mzuzu will spent the next 10 years in the cooler after the Mzuzu Magistrate Court convicted him for defiling a four year old girl (name withheld) in March this year.
Last month the same court sentenced another HIV positive Tobacco Tenant to 16 years imprisonment with hard labour for defiling his boss’s 10 year old daughter.
Robert Phiri, 26, of Chakhaza village, Traditional Authority Chakhaza in Dowa district pleaded not guilty to defilement contrary to section 138 (1) of the penal code.
But the state led by Vickness Simwinga paraded six witnesses and successfully proved the case against him beyond reasonable doubt.
Simwinga told the court that Phiri coaxed the girl to go with him and fetch some mushrooms but defiled her.
Some passerby caught Phiri in the act after they had incessant cries from the bush.
Simwinga asked the court for the maximum sentence saying such offences were rampant in Malawi and that the girl had lost her virginity.
Magistrate Anthony Banda agreed with state and sentenced him to 10 years imprisonment with hard labour.
In a related development Police in Mzuzu are keeping in custody a 38 year old man on allegations that he defiled his 12 year old step daughter.
Community policing members arrested Mike Chisale of Namanja village, Traditional Authority Mabuka in Mulanje district at Nkhorongo in Mzuzu after they received a tip off about the accused’s bad behaviour.
The girl told Police that her step father started sexually abusing her last year and swore her to silence. But the girl decided to reveal the ordeal after she got tired.
Police have charged Chisale with defilement contrary to section 138 (1) of the penal code.
