10 reasons why Jane Ansah must never resign

The first fact is that UTM Party leader Saulos Chilima and Malawi Congress Party (MCP) president Lazarus Chakwera went to Court because they claim there was rigging. They want the Constitutional Court to judge whether there was rigging or not the May 21 Tripartite Elections . The UTM/MCP case is not filed against Malawi Electoral Commission (MEC) chairperson Jane Ansah.*

Ansah has unequivocally stated that she will not resign unless the court rules that there were irregularities in the elections.
  1. On the principle that everyone is innocent until proven guilty, the Court has not judged whether there was rigging or not. *Why should we judge and treat Jane Ansah as if she is guilty before the Court decides whether there was rigging or not?*

3: MCP and UTM are struggling to file convincing evidence in the Court. _Do you remember that Chilima applied to the Court for his IT experts to access MEC servers?_ The fact is: IT experts accessed the servers and found ‘NO RIGGING EVIDENCE’. So, the UTM/MCP strategists decided to divert anger towards Jane Ansah in order to sustain more pressure on the Court because *Chilima and Chakwera know that they have no case; and they think they can only win the case buy putting the judges under duress. This is why Jane Ansah is a victim*.

4:Most Malawians (including very educated people) are cheated to believe Ansah’s resignation would end violent demonstrations. In reality, *the plan is to make her resignation a reason for sustaining the campaign of violence.*

5: Chilima and Chakwera want to justify to their supporters that indeed MEC was wrong and that there was rigging. Resignation will be used as an acceptance of wrong doing. The moment Jane Ansah resigns, Chilima and Chakwera will tell their supporters that she has accepted that there was rigging and they are vindicated.

6: Chilima and Chakwera will use the argument that Jane Ansah has accepted that there was wrong doing to create more anger and incite more violence and start demanding the resignation of Peter Mutharika without waiting for the judgement from the Court. *The demand for the resignation of Jane Ansah is only a trap.*

7: The truth before God is that Chakwera and Chilima lost the Election. President Peter Mutharika won the re-election. But Chakwera and Chilima need to save their faces before their supporters. They don’t want their supporters to look at them as losers and failures because that perception would be the end of their political careers. That is why they created the bie lie of ‘Tabeledwa’.This lie is giving their supporters a political drive and a cause for fighting. But they had to invent someone to be the target of that fight. The innocent Jane Ansah became the sacrifice and victim. Why must she resign?

8: The real political objective of the current fight is to make Chilima and Chakwera feel politically relevant. As a matter of fact, the violence is a source of funding for them because some people are contributing in faith that violence will force the Court to judge that there must be a rerun.

9:Chilima’s and Chakwera’s greatest fear is the fear of being buried in the political oblivion. Their personal quest for political relevance has nothing to do with the innocent Jane Ansah.

10: The resignation of Jane Ansah will be the dissolution and end of the Malawi Electoral Commission because, constitutionally, there cannot be a MEC without a Chairperson. On the day Jane Ansah resigns, MEC will constitutionally cease to exist because MEC is constitutionally incomplete without a Chairperson.

In fact, neither MEC nor Jane Ansah can be tried in Court to testify and answer the tippex case once she resigns. This is the greatest contradiction and mother of all lies: Why does Chilima and Chakwera want Ansah out of the way and want her to answer the case in court at the same time? Why do they want MEC dissolved and try the same MEC in Court at the same time? Can’t we all see that something is not adding up? Someone is lying to Malawians and taking us all for a ride.

Postscript

Appointing another Chair in this political environment of violence and intimidation? Which Supreme Court Judge will accept to inherit the hate lavished on Jane Ansah and accept to take her place while the matter is in Court? Jane Ansah’s resignation is designed to create a constitutional crisis, to complicate the case that is in Court and force the Court to declare a rerun on the pretext of public interest.

The demand for the resignation of Jane Ansah is the mother of political lies. It follows the nice lie of  ‘Tabeledwa’ whose real political objective is to make Chakwera and Chilima achieve political relevance in order to escape relapsing into a political oblivion.

Unfortunately, most of us Malawians have become too dull with social media frenzy because we don’t want to think and analyze things carefully. We are too lazy to think. We are the ones to blame for accepting all this violence and hate based on lies!

  1. This is a rubbish article. There are three good reasons why Ansah should resign
    1. The country is suffering because of only one woman. Whether she is guilty or not she should have a moral obligation not to let blood on her hands. After all she is a woman of God (as she claims to be).
    2. She has publicly confessed that she instructed the people who were conducting elections not to use correction fluid, when they used it she went ahead and used those voting papers. That is failure in her management and judgement as a Chief Executive of MEC. Failure to follow your own rules warrants resignation.
    3. The three Presidential contestants , Mutharika, Chilima and Chakwela have publicly admitted and agree that their own votes were stollen by the others. That is proof in itself that the elections were badly conducted.

    Malawians in authority need to change their mindset that when they do something wrong they cannot be held responsible. As a high Court Judge what authority can she have in judging others if she can reflect on her own mistakes..

  8. Well, if we look around and see what is happening and how things went on in court I think it would be wise to say the guy who is posting the points above concerning Ansah is not being objective. Has he anaylsed all the evidence presented by UTM and MCP presented in court? How about the recent article on Nyasa times about Ansah not producing the documents she used to legally announce APM, the president as a winner? Besides, we have had elections chaired by others before Ansah and have had people changing presidential seats but the outcry of the ones who lost never reached the extent we are experiencing now and neither did anyone demanded that the MEC chairpersons of that time to resign. Something might have gone wrong and the court has to decide as the matter was presented in court.

  11. Hey Rascal, i think you dont know what is happening, demonstrations are being organized by HRDC not UTM and MCP, chilima and chakwera are just joining them as concerned citizens…. When the IG of police wrote a letter trying to stop demos did he address it to UTM or MCP? U are dumb enough not to that it was addressed to HDRC.. attorney general tried to broke demos as well by obtaining injunction, who went to the high court to argue? Was it mcp or utm? Ur article is baseless.. follow current affairs and come back with something tangible

  47. There’s no universal position in government owned agencies. Jane Ansah can be replaced at any moment. If she’s still the head of MEC in 2024 then people won’t vote.     1. Constitutionally, had Chilima resigned he would have lost all his terminal benefits. Chakufwa Chihana resigned as Second Vice President. He lost his terminal benefits that go with that office. He took the issue to the High Court where he was unsuccessful. Judge Duncan Tambala presided over the case. Jane’s issue is different. She was picked up merely to be a MEC Chairperson. If she leaves that job she will get all her perks and go back to the Judiciary where she is still a Supreme Court Judge. However, it is up to her to decide whether to resign or not. Discretion at play, so to say.

    2- how did you know Mec is clean of the rigging argument??
    3- Jane Ansah SC accepted that in some parts of electrol centres the irregularities were seen like the Use of Tipex. By that how are you Justifying that the election was credible??
