‘Fake results sheets’ Ndasauka describes MEC documents in court

One of the key witnesses for the first petitioner in the ongoing elections case, Darlington Ndasauka, on Tuesday told the Constitutional Court in Lilongwe that some of the documents with results of the May 21 presidential elections tendered by the Malawi Electoral Commission (MEC) were fake.

Ndasauka, who was a team leader for UTM Party monitors, the third witness in the elections petition case after Chilima and the party’s roving monitor Miriam Gwalidi,  told the court during  re-examination by lawyer Marshal Chilenga that the documents with elections results he was cross examined were “fake”.

“It is fake documents,” said Ndasauka.

“The results of this document reflects fake because this is a fake document,” he added.

Ndasauka said features of the documents showed it had no bar codes, missed some originality from the genuine documents by MEC.

“Though this document is signed by monitors but it is fake,” he said.

Ndasauka also pointed alterations and irregularities including changes of presidential tally sheets.

But the re-examination faced a lot of objections from Attorney General (AG) Kalekeni Kaphale, who is representing MEC and Frank Mbeta, one of the lawyers representing first respondent President Peter Mutharika.

Kaphale and Mbeta argued that it was not proper for Chilima lawyers to ask Ndasauka questions which were not tackled in cross examination  in the historic elections case.

Mneawhile, Ndasauka has finished giving his evidence and a fourth witness  UTM’s Frank Nkawanga is next to take the witness stand.

Chilima and Malawi Congress Party (MCP) president Lazarus Chakwera are seeking the nullification of the presidential results in the May 21 2019 Tripartite Elections, aguing the poll was marred by irregularities.

  4. THE TRUTH OF THE MATTER IS FATTANI PRINTERS PRINTED FAKE BALLOT PAPERS FOR DPP.. THE DUBAI PRINTER PRINTED BALLOT PAPERS WHICH HAD UNSEEN SECURITY FEATURES THAT COULD ONLY BE IDENTIFIED BY THE PRINTER BECAUSE ITS A SECRET SO THAT IN CASE OF ANYTHING THEY CAN EASILY IDENTIFY THE DOCUMENTS.

    UNFORTUNATELY FATTANI COULD NOT MATCH THE SECURITY FEATURES AND ENDED UP MESSING THE WHOLE ELECTION PROCESS. ANY WAY THE GENERALITY OF THE ISSUES IS: THE ELECTIONS WILL BE DECLARED NULL AND VOID AND THUS A RERUN WILL BE ANNOUNCED. THE TRUTH BE TOLD THE ELECTION WAS DELIBERATELY MISMANAGED BY MEC AND DPP FOR THEIR PERSONAL GAINS.

    TRUST ME GOD HAS EXPOSED THESE CROOKS AND THEIR TIME IS OVER.

  5. People were trained hence by mec hence it evidence enough manipulation took place. They were told which one is orignal and which one is not, now same people are able to distinguish result sheets. Dpp and its criminals must fall.

  10. Just because Mr Ndasauka thinks it is fake doesn’t make it so. What if MEC says it is genuine? Generally the owner of the document knows best about what is fake or not. That is why fake certificates are taken to the issuing authority for confirmation. Think people

    1. MEC organised an orientation of monitors on how both “genuine and fake” electoral documents look like and this gentleman is using the same knowledge and or information to describe what was used…………………….! I take this argument as too shallow and empty……………………….!

    5. Did you read the article? He explained the features that made the document fake. It’s just like money or most official government documents. They have seals or watermarks for identification. I guess you lack common sense. After all, Kaphale did not defend the document as being real which means he knows the truth about the fake document.

  13. the problem is they thought after bribing monitors they will go away with it forgetting somebody somewhere was cross checking the authenticity of the electoral process

    2. signing it does not make it original…….they signed without knowing it bcause it was inthe evening……

      The papers are fake….where did MEC get these fake documents and why? Did the DUBAI company print fake papers? ….and how many were they?

      Some of those documents were not signed by UTM monitors but rather by DPP monitors……DPP monitors signed all the fake documents.

      1. what is important are the figures entered on the paper. even the results were to be recorded on plain paper and signed for this would mean valid votes. these two parties were not serious in training their monitors. they could have shown shown their monitors genuine and fake result sheet so upon seeing it being fake immediately they(monitors) would have rejected the signing.

          1. were the so called genuine sheets swapped with the so called fake ones which resulted in difference in figures or the genuine results were just written on the so called fake sheets? It is obvious that the genuine results would remain genuine even if they were written on a so called fake sheet. What is interesting is that all the witnesses have so far agreed with the lawyers from defense team that the results remained unchanged genuine regardless of the sheets that they were written on

If MEC was aware that what is important are the figures not a special type of paper why did they waste time and money and ordered the papers from Dubai?
