Ansah resigns as MEC chairperson: Pens Malawi leader
The embattled Malawi Electoral Commission (MEC) chairperson Jane Ansah has disclosed that she has resigned from her position and has written President Peter Mutharika as the appointing authority informing him about her decision.

Ansah revealed this on Thursday evening in an exclusive television interview with public broadcaster Malawi Broadcasting Corporation (MBC)
However, Ansah said she is yet to get a response from President Mutharika.
“But I believe he respects my decision,” said Ansah, a judge of the Malawi Supreme Court of Appeal.
Ansah also said her decision to resign stems from a fact that Supreme Court upheld the High Court sitting as the Constitutional Court ruling annulling the May 2019 presidential elections and faulted MEC to have been mismanaged the polls.
“I leave full of confidence. I have worked with clean hands and I have no skeletons in my cupboard. I have fought a good fight and I am happy that I have seen it to the end,” she said.
Ansah said she was not moved by demonstrations against her which where organised by Human Rights Defenders Coalition (HRDC), saying they were acts of lawlessness.
“The right to demostrate has a limitation because the constitution says demos must be peaceful, the demos were not peaceful and ceased to be a right. I could not budge to demostrations (lawlessness) because that would have set a very bad precedence,”’said Ansah.

On April 1 2020 MEC chief elections officer Sam Alfandika told Parliament’s Legal Affairs Committee that the commission wrote President Mutharika to consider hiring new commissioners as the current ones’ tenure is expiring on June 5.
Legal scholars have since asked Mutharika to enhance the credibility of the forthcoming presidential election by replacing the commissioners.
Garton Kamchedzera, a professor of law at Chancellor College, a constituent college of the University of Malawi, said under the circumstances, it is in the best interest of Malawians for the President to appoint a new commission.

Incompetent Ansah broke so many laws relating to elections (even under PPE Part XII(e)) that I find it so laughable that ‘zero-integrity’ Ansah has the ‘guts’ to point fingers at, much less condemn the many acts of ‘lawlessness’ of ‘peaceful demonstrators’ that never happened. No demonstrator perpetrated violence or engaged in any acts violence, it was VANDALS that wrecked mayhem most of them supporters of clueless Mutharika!!!.

The reason MCP has not accepted losing an election is because every one has been rigged. It’s just that the opposition, encouraged by the majority of Malawians, were fed up and felt enough was enough and decided to take legal action which has led us to where we are now.

Mayi Ansah, I beg to differ on your take of the demos. Me still thinks the demos were meant to be peaceful but the DPP in trying to cling to power were deliberately “planting their cadets” to destabilize the demos to paint the organisers and participants in a bad light. I understand that this week you commenced legal proceedings that sought court’s intervention in the capacity of mec commissioners to execute their duties as espoused by the relevant laws.
Counsel, by and large, I conceive this as part of the grand scheme to tactically subject you to withdraw your case as the substantive issues that compelled you to seek legal redress have apparently been resolved on the part of mec. She expects you to withdraw the case. After this, as no press briefing or any evidential material purporting to validate her resignation has been made public, she will come out of her cocoon to refute the news item carried by MBC regarding her resignation. Definitely MBC does not mind to be used as a pawn. By this time, when you will have danced to her tune, there will be no enough time to start the whole case all over again up to its logical conclusion such that she will still act as the mec chairperson.
So, in short, Ansah is trying to dodge your case so that upon your withdrawal, she might refute the news and still proceed in her duties up to the very end of her contract. If you think I am daydreaming, just take a look at how she has behaved in the past 12 months. At first she explicitly said that she is going to resign if the constitutional court found that MEC did not carry out its duties as espoused by the constitution and relevant laws subordinate to the supreme law but after the said court’s ruling she remained adamant of her earlier decision. And even hours after the supreme court’s ruling, she remained equivocal.
To this end, counsel, I think she knows that her weak spot is her legal demeanor. She doesn’t care about her moral obligations and this is why she never moved an inch when demonstrations were organised to force her to resign. However, with the legal battle you commenced, she knew that you had hit hard on her weakest spot. To offset that, she would want to dodge you as explained earlier on. Do not withdraw that case counsel.

How on earth did this lady ever become a judge? Her friends in the Supreme Court ruled against the government when it moaned that it could not control the demonstrators, the police saying that they did not have proper riot-control gear. The top court told the government that people DID have the right to demonstrate, and that government should take the necessary steps to facilitate them.

He needs to .make available the laptop which was found in Mozambique for independent investigation. My thinking is that the hard drive was cloned in Mozambique. If true, the laptop which was sent back is a clone and will not show any tampering. If true, the real MEC laptop, is the ghost machine transmitting data to the MEC data center. It already has access previleges to transmit data. If the cloned laptop
stayed in Mozambique, it could mean that a hacker tweaked the software to mimic one of the MEC laptops transmitting to the data center. Without an independent forensic computer scientist to verify hardware and software specs on the stolen laptop, someone is going to win through tech fraud. The whole MEC system needs systematic vetting by an independent data security and a forensic software engineer.
The key question is this; what gave Judge Ansah the degree of confidence to justify unauthorized systematic use of tippex as normal? If everything (faulty vote counting) was the same for all candidates, then the laptop must have made the difference.

While I join others that are breathing a great sigh of relief, my biggest worry now is that what if ‘brain incapacitation’ has set in, in the ‘interim’ President’s mindset? It is possible that due to his age, the ‘interim’ President’s capacity to make ‘reasonable’ decisions has decreased greatly. Probably those living close to him understand him better. Remember he used to go abroad frequently for medical attention (at one point staying in the USA for more than two months), but now with the coronavirus-related travel restrictions, this might be no longer possible. As a professor of law, one would have expected that his decisions would respect the rule of law but there is evidence that he is having considerable difficulty understanding and respecting the laws of the land. For instance he might decide (as the brain of a child would normally compel it) that he does not understand why the Courts have decided that there should be fresh elections, when in his brain there is all the convincing ‘evidence’ that he legally ‘won’ the May 21 2019 Presidential elections. If his brain continues to send such convictions to his mind, the chances are that he will keep wondering why there is such a fuss about fresh elections? If this line of thinking from me is far fetched, let’s wait and see whether or not my theory might turn out to be exactly what is happening now at Sanjika Palace. Malawians will wait, and wait and wait…….just like DPP followers have been waiting and waiting to see him in public campaining for the past two weeks to no avail. I guess our Constitution has the answers and solutions when it comes to a sitting Acting President in office becoming mentally incapacitated.

At last! At last! How the mighty are fallen! After all the pigheadedness, the arrogance, the impudence and it all ends with this whimper? After putting the country through unnecessary tension, after making the country needlessly spend billions of Kwacha which could have gone to much more deserving projects and it all ends in this anti-climax?
Appointing authority? The appointing authority are the people of Malawi, the Head of State is just delegated this responsibility. This is the main lesson to be held to heart by everyone holding a public office: You work for the people of Malawi, not the president or the “ruling” party. When people forget this important lesson, what follows is chaos. The MEC commissioners, the police IG, the Attorney General, all PS’s, all parastatal heads, etc all work for the people of Malawi…
Of course, this will not be the end of it. A full inquiry will have to be conducted some time after the FPE. The country will need to know what led to the madness of the 2019 TPE; and appropriate punishments will have to be meted out.

Long at last the Jezebel is gone, after causing so much carnage in our country…..I just hope that considering all the misery she has caused, she will be leaving MEC without being paid any Tambala.
APM will pay her from his pocket for helping him win the rigged elections in May. She has wasted millions of taxpayers money due to her arrogance…..appealing a case she should not have done, hiring foreign lawyers, hiring the attorney general Kaphale in an arranged syndicate to steal money from government, now she has resigned because the ombudsman has started an investigation on how this happened. The investigation will continue and she will still be held to account, this is a fact.
We now need someone of integrity to manage the June elections and I would like to propose the name of Martha Chizuma the current ombudsman to lead MEC into the next elections……she is the only woman of integrity that every Malawian can trust.
Am hearing that APM want to replace Ansah with another cadet in the name of Seodi White, and if this is true I would like to warn APM that no Malawian will accept his nonsense anymore…..that’s all I can say.

Because by June 23rd, she would have still been out of MEC anyway (having retired officially on 5th June) There will be celebration on tomorrow’s Father’s Day.
She was due to retire as MEC chair in October this year. It’s the other commissioners whose terms are expiring on 5 June, Since her official term runs up to October, she may still preside over the 23 June FPE if APM decides to refuse to accept her resignation. She has not said that she is resigning with immediate effect; she seems to imply that her resignation will be effective upon acceptance by APM (“the appointing authority”).
However, the numbers and most importantly the need to strictly adhere to the legal requirements governing elections are very much against the MuMu Alliance. Not even Ansah and the current commissioners can manufacture a DPP win. Results sheets will have to be original, signed, and unaltered. And the final national result will have to be reconciled to the District, constituency and polling center results. All these measures were not followed last year

As a matter of fact the same goes for Muthalika, instead of going through this humiliation at his age, if he had given up at the last election saying am too old for this, let someone else stand for the party, he would have left a better legacy albeit awash with incompetency, but a better legacy nonetheless. This country belongs to us all and what she has done was long overdue. No one person has all the intelligence of running MEC as if it is a personal estate. There are more capable individual in the legal fraternity that can do much much better. Anastasia Kusowa did a very good job during her time. Hearaly Potani is another brilliant lawyer and many more in Chancellor College and other Universities in Malawi can do better
