ACB arrest lawyer Mumba for ‘swindling’ client

Malawi’s Anti Corruption Bureau (ACB) on Tuesday arrested Blantyre-based private practice lawyer Shepher Mumba of Golden and Law firm for allegations of swindling a client.

ACB spokeswoman Egrita Ndala said in a statement obtained by Nyasa Times that the bureau received a complaint on 19th July, 2010, alleging that Mumba did not remit K400, 000.00 which was part of compensation received from Citizen Insurance on account of Ellen Kandaya.
The graft-busting body said  it instituted investigations “which confirmed the allegation.”

After being arrested on Tuesday, November 22, lawyer Mumba was taken to Blantyre Magistrate’s Court to be formally charged.

“He was charged with one count of theft contrary to Section 278 as read with Section 288 (c)of the Penal Code and one count of obtaining money by false pretences contrary to Section 319 of the Penal Code,” ABC spokeswoman said in the statement.

The lawyer was  released on bail on the conditions that he deposit with the Court the sum of MK50,000.00 cash  and ordered toto the Anti-Corruption Bureau offices in Blantyre once every week on Wednesdays .

He was also asked to provide one surety approved by the Court in the sum  of K100,000.00 not cash and surrender travel documents to the ACB. He will not travel outside Malawi without the authority of the Director of ACB .

ACB said it will start prosecuting Mumba on a date to be set by the court for trial.
